About this file
This document is an amendment to Solicitation N0017424R0051 for a Foreign Military Sales (FMS) Programs Multiple Award Schedule (MAS) IDIQ contract. The purpose of the amendment is to provide responses to bidder questions. There are no changes to the original solicitation as a result of the questions.
The solicitation is for multiple indefinite-delivery, indefinite-quantity (IDIQ) supply contracts to provide hardware, materials, supplies, and training services to support FMS requirements. The items will be commercial off-the-shelf (COTS) and in support of Explosive Ordnance Disposal (EOD) and Counter Improvised Explosive Device (CIED) requirements. The contract is set-aside for small businesses. The solicitation does not include a Statement of Work or Performance Work Statement, but provides an example task order for pricing purposes. Responses are due by the date specified in the original solicitation, and the contract will be awarded to up to three small business contractors.

The following items are applicable to this modification:
AMENDMENT 0002
The purpose of this amendment is to answer bidder questions. There are no changes to the solicitation as a result of the questions.
1. QUESTION:
In section B for pricing, it shows that for CLINS 1-20 as NTE budget totals. The pricing section states that we should respond to the example task order, but then it also mentions pricing on items in Section B that are not defined. What would be the correct way to fill out the pricing in section B?
ANSWER:
Offerors shall provide pricing information for Task Order 0001 – Kick Off Meeting and provide a cost estimate in Attachment 2. Section B provides the IDIQ, Not To Exceed Amounts, therefore Offerors do not need to provide pricing for this section. Please review pages 127 and 128 of the solicitation, “Volume III – Price” for the guidelines to complete pricing.
2. QUESTION:
Clause 52.212-5 – Notice of Total Small Business Set-Aside, RFP Page 47: Some of the OEMS/manufacturers/suppliers listed in the attachments are not small businesses. Please provide clarity on whether these companies can be used to fulfill the small business requirement, or if the offeror only needs to be a small business.
FAR 52.219-6 Notice of Total Small Business Set-Aside
(c) General.
(1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.
(2) Any award resulting from this solicitation will be made to a small business concern.
3. QUESTION:
SOW 3.2 – Kitting, RFP Page 16: Can IDIQ awardees/prime vendors bid their own kits with their own part numbers through this contract?
Yes, bidders can provide their own part numbers and pricing on their own kits to meet the requirements of the solicitation.
4. QUESTION:
Do you have a template or format that you would like the Proposal for evaluation? Please send over an example so we can match our format to what is expected.
ANSWER:
Bidders are not required to use a template and shall refer to Section L - Instructions, Conditions, and Notices to Offerors for format requirements and other proposal requirements.
5. QUESTION:
The sample task order requires a training team, the country of training is generic. Are you going to provide a price plug for the travel costs or should we use an average cost for hazard and hardship pay, per diem, air traveling lodging?
In accordance with Section 1.0 of Attachment 2, “it should be noted that all items and services should be proposed as a firm fixed price (FFP) and should not include travel”.
6. QUESTION:
As of 2022, there is a NIJ rated equivalent bomb suit to the Med-Eng Bomb Suit. Will the US Government accept an equivalent capability bomb suit to Med-Eng that meets all requirements. This bomb suit is already in service in the British Armed Forces.
It depends upon the FMS Case Letter of Offer and Acceptance (LOA). If the LOA specifies Brand and/or Part. #, we are required to procure specific item to meet intended CONOPS and outfitting requirements of the FMS Customer if item is available. If the LOA does not specify Brand and/or Part. #, we are allowed to consider suitable alternatives to satisfy FMS Customer requirements. The individual order will specify whether or not the LOA requires a Brand Name, equivalent, or if a substitute is allowable.
7. QUESTION:
Is there a sample list of items you need pricing on? If not, is there a list of specs for items you need quoted?
The sample delivery order identified in Attachment 2: Example SOW for Pricing is a sample representation of the types of equipment that will be procured under this contract. They won’t be the exact items procured under this contract. Offerors will provide a cost estimate in Attachment 2 for the sample delivery order. Individual orders will specify items being procured after award of IDIQs.
8. QUESTION:
Do you need pricing quoted? Do you need out year pricing? How many years?
ANSWER:
The sample delivery order identified in Attachment 2: Example SOW for Pricing is a sample representation of the types of equipment that will be procured under this contract. They won’t be the exact items procured under this contract. Offerors will provide a cost estimate in Attachment 2 for the sample delivery order. Individual orders will specify items being procured after award of IDIQs.
9. QUESTION:
Will all items be shipping CONUS? If so, will all be shipping to the same CONUS location? If so, can you provide the zip code?
ANSWER:
Specific items and locations will be specified on individual orders after award of the IDIQs. For pricing purposes of the multiple award IDIQs, please refer to Attachment 2.
10. QUESTION:
Is there a potential for OCONUS shipping? Will ITAR be a factor? If shipping OCONUS is potentially an option, can items be shipped to a CONUS consolidation point for forwarding?
Yes, there is a potential for OCONUS shipping.
In regards to ITAR compliance, please refer to Section 7.0 of Section C (Statement of Work).
All equipment at NSWC IHD except for exceptionally large/heavy or delicate items which will ship in place at OEM, then a USG-arranged carrier would collect items from OEM Facility and ship to a designated final destination in country.
11. QUESTION:
Do all items need to be Berry/TAA compliant?
The Buy American Act to procure Berry/TAA compliant items is required whenever possible but if a Berry/TAA compliant item is not available, a suitable substitute may still be acceptable on a case by case basis, as long as it meets the fit, form and function. If this is the case, it will specified on the individual order.
12. QUESTION:
As part of the EOD Tech DIV FMS RFP, ref attachment 2, item 5, the MTM from L3Harris. Per the manufacturer, the item is no longer available. Two alternates exist. The Skeet IR from Trijicon and the Voodoo S from Pixels on Target. Would you like more information?
If an item is deemed obsolete, please provide a suitable substitute with your proposal, as well as the item’s product specification sheet.
13. QUESTION:

ANSWER:
Section L, 3.0 Instructions for Submission of Offers, provides the instructions.
14. QUESTION:
