Post-Solicitation Industry Questions Round 4

Question 1: Will Certified Cost or Pricing Data be required for this contract?

Answer: According Section M 3.1.7.1 and FAR 15.403-1(b)(1), “The contracting officer shall not require certified cost or pricing data to support any action… When the contracting officer determines that prices agreed upon are based on adequate price competition.” Therefore, since the Contracting Officer has determined that there is a high probability of price competition for this acquisition, certified cost or pricing data will not be required in the initial proposal submission.

Question 2: The Columbia Class Bearing Support Structure Solicitation page referenced Updated Inactive Date: August 25, 2022. The Amendment 2 references a due date of 10 August 2022. We just request clarification of the specific due date between the solicitation page and the Amendment 2.

Answer: The proposals are due on 10 August 2022.

Question 3: The 2.3.5 Section L and Proposal Volume Cross-Reference Table state the Cover Letter is referenced under Volume column as (N/A), but the column to the far right references Page Limitation with Volume I: 75 pages. Please clarify in the Cover letter should be a stand-alone document separate from any other Volumes.

Answer: The Cover letter should be a stand-alone document separate from other volumes.

Question 4: Following up on the Post-Solicitation Industry Question Round 3, Question 1, the US Government’s response is clear that first the material price is revised (based on the current copper / nickel price per ton), and then “EPA clause would then be activated and allow a material price adjustment up to 25% from the revised material price.”

With this, we interpret FAR 52.216-2, Economic Price Adjustment, paragraph (c)(1) reference to the “original contract unit price” to mean the revised CLIN unit price for each CLIN 0001AB, 0002AB, 0003AB, 0004AB and 0005AB after the material price is reviewed based on the current copper / nickel price per ton. Please confirm.

Answer: The Government can confirm that the FFP-EPA clause will be activated and will apply to the revised CLIN unit prices for SLINs 0001AB, 0002AB, 0003AB, 0004AB, and 0005AB.
