DEPARTMENT OF THE NAVY

NAVAL SURFACE WARFARE CENTER

CARDEROCK DIVISION

J&A Number: 0223-19-019-00 Code: 02 P.R. Number: 1300792457

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

Naval Sea Systems Command, Naval Surface Warfare Center-Carderock Division (NSWCCD), Code 02.

2. Description of the Action Being Approved

This is a sole source action to be awarded without providing for full and open competition. The proposed contract action is a maintenance service, training, and spare parts contract to be awarded to Mirion Technologies, Inc. located at 5000 Highlands Parkway SE #150 Smyrna, Georgia 30082. It is anticipated that this proposed requirement will be met using a Firm Fixed Price (FFP) contract.

3. Description of Supplies/Services

The Navy has a requirement to monitor the levels of contamination on tools and personnel in shipyards. Cronos-11 (Tool Contamination Monitors) are extremely sensitive instruments used to detect gamma radiation on articles such as waste bags, tools, and hard hats. GEM-5N (Portal Monitors) are large and sensitive instruments used to detect gamma radiation on personnel and worn clothing. Tool Contamination Monitors and Portal Monitors are used at Department of Defense and Department of Energy facilities in support of Naval Nuclear Propulsion Program (NNPP) work.

This contract is a service contract to provide preventative maintenance, emergency visits, training, and spare parts kits for the Cronos-11 and GEM-5N monitors at NNPP sites. Preventative maintenance shall maintain the system in optimum performance and working condition. Emergency visits to the site shall be performed to repair the system. Initial service response shall be within 72 hours failure notification and the disabled system shall be returned to service within three business days of failure notification for Continental United States (CONUS) sites. For Outside the Continental United States (OCONUS) sites, the disabled system shall be returned within four business days of failure notification. Each site will be allowed up to two on-site emergency visits for each year of the contract term. Training shall provide and document comprehensive, on-site (Navy/NNPP) Cronos-11 and GEM-5N system maintenance training in conjunction with a scheduled annual preventative maintenance visit at Norfolk Naval Shipyard (NNSY), Portsmouth Naval Shipyard (PSNY), Puget

Sound Naval Shipyard (PSNS) and/or Pearl Harbor Naval Shipyard (PHNS). The training requirement shall train shipyard supervisory staff and technicians on the use of new features, components, or equipment and shall be approximately eight hours. Spare parts kits are required to have a full complement of operational parts for minor repairs.

The below table provides estimated costs by year for the Cronos-11 and GEM-5N Maintenance Service, Training, and Spare Parts Kits.

FY 19 FY 20 FY21 FY 22 FY 23 Total $3,649,958

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (FAR 6.302-1).

5. Rationale Justifying Use of Cited Statutory Authority

The Cronos-11 and GEM-5N systems are currently the systems in place across the Navy within the NNPP, and all technical aspects of this system (including software, detector functionality, and electronic hardware) are proprietary to the Original Equipment Manufacturer (OEM), Mirion Technologies.

Mirion Technologies is the only company that supports the Cronos-11s, GEM-5Ns, and the software used in conjunction with the monitors. Because of software, hardware, and detector proprietary restrictions, it is not possible for any other company to gain the same level of working knowledge regarding the Cronos-11 and GEM-5N systems as Mirion Technologies in order to maintain the systems.

To award the maintenance service to any other source would require a replacement of the Navy’s current contamination monitor infrastructure. New tool contamination monitors and portal monitors would have to be purchased and implemented within the Navy so that this different source could maintain its own contamination monitoring system. Such a replacement would also require a re-training of all Navy personnel worldwide who perform work with the system, as well as a complete revision to all policies and procedures related to using the contamination monitoring system.

Such a replacement to the Navy’s current contamination monitoring system is not practical and is schedule and cost prohibitive. The cost for replacement was estimated to be $6,734,100. A cost breakdown is as follows:

Procurement of new tool contamination monitors 16 new tool contamination monitors x $90,800 per monitor = $1,452,800

Procurement of new portal monitors 67 new portal monitors x $63,900 per unit = $4,281,300

Establishment of new use and processing policies and procedures (new tool contamination monitor):

Two man-years of work (4,000 hours x $100/hour) = $400,000

Establishment of new use and processing policies and procedures (new portal monitor):

Two man-years of work (4,000 hours x $100/hour) = $400,000

Revisions to software programs:

One man-year of work (2,000 hrs x $100/hr) = $200,000

Total Estimate: $6,734,100

Therefore, Mirion Technologies is the only company that can practically and cost-effectively provide maintenance services, training, and spare parts kits in support of the Navy’s contamination monitoring requirements.

6. Description of Efforts Made to Solicit Offers from as Many Sources as Practicable

A sources sought was posted to Federal Business Opportunities (FedBizOps) for a period of 15 days.

Zero companies responded to the sources sought notice posted to FedBizOps; however, the technical code conducted market research by researching market catalogs, conducting internet searches and contacting market experts prior to submitting the package for this requirement. The technical code concluded through their market research that Mirion Technologies was the only company that could provide the desired maintenance on their proprietary equipment. This acquisition will be sole sourced based on Mirion’s singular ability to provide maintenance on the Navy’s current contamination monitor infrastructure.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the costs to the Government for the services covered by this J&A will be fair and reasonable, in accordance with FAR13.106-3.

8. Actions to Remove Barriers to Competition

At the end of life (EOL) of the Cronos-11 and GEM-5N systems, NSWCCD will conduct market research to determine if other manufacturers of contamination monitors meet the Navy’s requirement. If other vendors are identified, they may be considered for future procurements. However, since the Cronos-11 and GEM-5N systems are currently in use Navy-wide and they are proprietary to the OEM, no other company possess the knowledge and expertise to perform the maintenance. Therefore, the Government continues to operate in a sole source environment until replacement of systems occur at a future point in time.
