About this file

This document is a Questions and Answers (Q&A) file addressing vendor inquiries related to a federal contract solicitation.

The first question clarifies First Article Testing (FAT) responsibilities under FAR 52.209-4. The contractor is responsible for manufacturing the first article unit and shipping it to the Government-designated testing facility specified in the solicitation. The Government will conduct required in-process inspections at the contractor's facilities and perform final testing and acceptance at Government facilities upon receipt.

The second question addresses CMMC Level 2 (Self-Assessment) compliance requirements. Offerors are not required to achieve final, unconditional CMMC Level 2 compliance at proposal submission. Under 32 CFR Part 170 guidelines, conditional acceptance is permitted for offerors with an active Plan of Action and Milestones (POA&M) meeting minimum requirements and scheduled to achieve full compliance within 180 days. Offerors must submit a valid, active CMMC Unique Identifier (UID) logged in the Supplier Performance Risk System (SPRS) with their proposal to satisfy Section L submission requirements.

Vendor Question Government Response

First Article Testing (FAT) Execution:

Are we as the contractor supposed to facilitate the first article tests or are we to produce the first article test unit and ship to your location for the testing to be completed?

The contractor produces and ships the unit for final inspection and acceptance.

In accordance with FAR 52.209-4 (First Article Approval - Government Testing) and the SOW, the contractor is responsible for manufacturing the first article unit and delivering/shipping it to the Government-designated testing facility specified in the solicitation.

Per the SOW, the Government will conduct the required in-process inspection(s) of the First Article units at the contractor facilities and will perform the final testing and acceptance upon receipt at Government facilities.

CMMC Level 2 (Self) SPRS Score & Plan of Action (POA&M):

The solicitation requires a CMMC Level 2 (Self-Assessment) and associated SPRS UID at proposal submission. If an oƯeror has completed a Level 2 Self-Assessment with an active Plan of Action and Milestones (POA&M) to achieve full compliance within 180 days, is the oƯeror eligible to submit a proposal, or must the oƯeror have achieved a final compliant score and SPRS UID at the time of proposal submission?

Conditional acceptance is permitted.

The solicitation does not require a final, unconditional CMMC status at the time of proposal submission. Under CMMC framework guidelines (32 CFR Part 170), an oƯeror with an active Plan of Action and Milestones (POA&M) meeting the minimum requirements may log a Conditional CMMC Level 2 (Self- Assessment) in the Supplier Performance Risk System (SPRS).

This action generates an active CMMC Unique Identifier (UID). OƯerors must submit this valid, active CMMC UID in their proposal to be considered compliant with the submission requirements of Section L.
