MILITARY SEALIFT COMMAND
N00033-12-R-8002
QUESTIONS AND ANSWERS
The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.
1. Are any historical volumes available by product, package style, and port delivered?
ANSWER: Yes, please see attached spreadsheet.
2. Do any other entities other than the Military Sealift Command vessels procure lubricants under this contract?
ANSWER: Yes, both Navy and National Oceanic and Atmospheric Administration (NOAA) vessels procure lube oil under this contract.
3. Section 3.0 Handling of Lubricants states that the delivery surcharges as listed on Attachment E are to be all-inclusive of all fees, taxes, etc. Because these charges can be imposed by outside agencies, and may vary by product and by the location within a port, it is difficult to quote an all inclusive price.
We will typically quote bid prices that exclude all taxes and fees; however, any additional charges are quoted at the time of ordering and are confirmed and approved prior to delivery. Additional charges are also listed separately on invoices so there are no fees or charges hidden in the unit prices. We believe this is a standard industry practice. Will this be acceptable to MSC?
ANSWER: No. Delivery surcharges shall be all-inclusive of all fees, taxes, and charges.
4. In reference to the Economic Price Adjustment (Section 12.6 of the SOW), who determines the
“Influence Factor” and how closely is it related to the percentage of base oil in the final lubricant? Is this something that the Contractor proposes, or that MSC has already established, or is it negotiated as part of the agreement?
ANSWER: The Influence Factor has been deleted from the Economic Price Adjustment section.
Please see Amendment 001 for revisions to Paragraph 12.6.
5. What is MSC’s expectation for the quotes for the future Option Periods? If pricing will change every three months and the next option period begins with the pricing in place at the end of the previous period, how would we provide a new quote? If we elect to make no further changes to pricing other than that as calculated in the EPA, how do we convey this?
ANSWER: As stated in FAR 52.212-1 ADDENDUM under Factor 4: Price on page 59, “Offerors are reminded in accordance with the EPA clause, if option prices vary from base year prices, such variation shall be reflective of Program Management costs rather than the costs associated with the lube oil products.” Therefore, if an offeror does not propose any changes to Program Management costs, then the unit price for products will remain the same for all periods of performance. The proposed pricing shall be evident in the completions of Attachment (E).
