The following factors shall be used to evaluate offers:
Factor 1: Technical Approach Factor 2: Past Performance Factor 3: Price
Each of the three factors will be evaluated on a stand-alone basis. Factors 1 and 2 will be evaluated on an “acceptable” or “unacceptable” basis. Factor 3 will be evaluated on a total evaluated price basis for reasonableness based on competition.
In order to be considered awardable, Factor 1 and Factor 2 must receive an “acceptable” rating.
The Government intends to initially evaluate Volume I of the three lowest priced proposals representing the best value to the Government only. If one of the three lowest priced proposals is found to be technically acceptable an award without discussions will be made. In the event the three lowest priced Offerors are not technically acceptable, the Government will evaluate Volume I of the next two lowest priced proposals. If neither of the next two lowest priced proposals are evaluated to be technically acceptable, the remainder of the proposals will be evaluated.
M-1 FACTOR 1: TECHNICAL APPROACH
Factor 1 will be evaluated and assigned an adjectival rating as follows:
Rating Definition
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
The Government reserves the right to assign an “Unacceptable” rating for Technical Approach if Offeror fails to submit supporting technical data as described in SECTION L, or where submitted data is incomplete.
The Government reserves the right to waive informalities and minor irregularities in proposals received. Acceptance of proposed items imbedded in the proposal supporting documentation does not commit the Government to
Answer (revised): Yes. The bid price should include all costs that will be incurred in complying with the solicitation, submitting the proposal, making any repairs, and delivery.

acceptance of items that do not meet the Specifications unless specifically stated in the Specification Response Matrix (Attachment 2).
The Offeror’s proposed technical approach shall be evaluated based upon the information submitted by the Offeror.
All information will be reviewed in detail to ascertain the quality and depth of the responses to the information required by Section L. To be determined as technically acceptable, the following shall have been provided and shall demonstrate that the boat meets the requirements of the specification and the statement of work of this solicitation:
A. Boat Description [L-3.1.1.A] – A detailed description of the boat as required in Section L will be evaluated to determine whether it is meets the technical requirements.
B. Boat Characteristics [L-3.1.1.B] - The characteristics of the Offeror’s boat will be evaluated to determinewhether the information submitted in Attachment 2, identified all required equipment and features inclusive of make and model and meets the technical requirements.
C. Boat Survey [L-3.1.1.C] - A recent in-water survey completed on or later than 1 March 2019 will be used to evaluate if the Offeror’s proposed boat meets the technical requirements.
D. Storage Delivery [L-3.1.1.D] - Offerors will be evaluated based on their proposed plan to store the boat for up to 14-days at or near the boat’s current location until delivery (FOB Origin) the boat to the destination as listed in Section F. and for compliance with Attachment 3, if applicable.
E. Ownership [L-3.1.1.E] - Clear evidence of ownership (title) or a detailed description of how the boat will be acquired and agreements in place to facilitate the purchase of the boat as required in Section L. If contractor fails to present proof of ownership to the Government within Five (5) business days after contract award the Government reserves the right to cancel the award for cause and award to the next LPTA Offeror. In the event of termination for cause, the Government shall not be liable to any contractor for any amount for supplies or services not delivered and accepted in accordance with FAR 52.212-4(m). If the Offeror does not submit the required information the proposal will be considered non-responsive.

Failure to conduct a Haul-out, Survey, Engine Survey and Sea Trial, upon request from the Government will render the proposal non-responsive. The results will be used to evaluate the Offeror’s proposed boat for technical acceptability. If after reviewing the results of this survey the Government determines the boat to be technically unacceptable, the Government may require a pre-award haul out, survey and sea trial from the next apparent winner’s boat until award can be made. The Government may, at its sole discretion, determine a boat to be technically unacceptable based on the quantity or magnitude of problems or needed repairs found as a result of the survey. The Government reserves the right to have the Offeror correct any survey items identified with respect to safety or technical acceptability during the course of the survey and require the offeror to bring such items into compliance with the specification within three (3) business days of notification by the Government, at no additional cost to the Government. Any request of the extension of the three (3) business days cited above is at the sole discretion of the Government. If the Offeror is not willing to correct these items, the proposal will be found technically unacceptable.
M-2 FACTOR 2: PAST PERFORMANCE AND EXPERIENCE
Factor 2 will be evaluated and assigned an adjectival rating as follows:
Rating Definition
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will successfully perform the required effort.
In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2)(iv)).
Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
M-3 FACTOR 3: PRICE
A. Price Analysis: The Government will not evaluate price adjectivally or assign strengths or weaknesses to the price proposal. The Government will analyze proposed prices as follows:
1. Total Evaluated Price. The price that will be considered for the LPTA determination is the Offeror’s CLIN 0001 price as listed in Section B
2. Reasonableness. The Government will evaluate the Total Evaluated Price for reasonableness based on competition.
B. Determination of Contractor Responsibility. Statements and representations made in the Offeror’s proposal may be subject to verification by Government Agencies, and/or through site visit or Pre-Award Surveys. Therefore, as part of its responsibility determination, the Government may conduct a site visit with any of the Offerors deemed necessary by the Contracting Officer. The Offerors may be required to make their production facilities available for a site visit by the Government as soon as two weeks after the submission of the proposal. The Contracting Officer may contact the Offeror to schedule the visit of up to eight (8) Government personnel. The conducting of a site visit or a Pre-Award Survey shall not constitute discussions.
FAR 9.103 requires that the Contracting Officer make an affirmative determination of responsibility prior to contract award. The Government intends to use the Defense Contract Management Agency (DCMA) to assist in the
Responsibility Determination and may elect to use additional private sector resources if necessary. Any adverse information discovered in SAM.gov will not be addressed by the source selection team and the Offeror may be considered not responsible by the Contracting Officer.
The Government may use additional private sector resources to assist in the Responsibility Determination in addition to information submitted by the Offeror. No award will be made unless the contracting officer makes an affirmative determination of responsibility. In the absence of information clearly indicating that the prospective contractor is responsible, the contracting officer will make a determination of nonresponsibility and follow the procedures of FAR 9.105-2 and FAR 19.6.
C. Administrative information: Offeror’s price proposal will be evaluated for completeness. Any administrative information omitted from the submittal may be addressed through clarifications, provided it does not affect eligibility for award.
Offerors should ensure Standard Form 1449 Blocks 17a and 30a-c, and any amendments are signed and returned with their quote and that Section K of the solicitation (certifications, representations and other statements) is complete. The reps and certs are in addition to the information in SAM.gov and Offerors must ensure 252.204- 7019- Notice of NIST SP 800-171 DoD Assessment Requirements is addressed.
(b) Options. (not applicable) The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
