QUESTIONS AND ANSWERS #5

The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.

154. Amendment 002 issued on 2/9/17 extended the bid due date to 3/27/17 in response to Round 2 of responses, Question No. 37. Since that date, no further amendments, ERRATAs or responses to questions have been issued. Also, several additional questions have been written since that time – many of them with significant problems concerning GFM discrepancies. We are requesting an extension of the proposal due date to April 24 to allow enough time for the Government to respond to the nearly 75 (minimum) unanswered questions, to provide the missing drawings and to sort out the GFM issues identified by our questions 049, 064, 088 and 090.

a. The Government extended the proposal period from 22 February 2017 to 27 March 2017 to allow additional time for bidder's questions and proposal preparation. The Government has since posted Questions and Answers (Q&A) #3, Q&A #4, and Q&A #5 in conjunction with RFP Amendments 2, 3 and 4, and ERRATAs 2, 3, and 4. The Government is working Q&A #6 and ERRATA 5 with (35) remaining bidder's questions. The ship's post-availability commitments do not support further proposal extensions. For this reason, the Government is not able to extend the proposal due date as requested.

155. Bidder requests clarification of the cost elements included in the above depicted Gov't pier differential value? Bidder requests a detailed list of Gov't provided pier and facility related efforts that will be provided by the Navy customer? Bidder requests detailed information regarding Gov't provided pier and facility related costs that bidder is responsible for, and as such must include in its proposed bid price?

a. The Navy will hook up and provide shore power, potable water, T-1 line and CHT at the government facility pier.

The offeror is responsible for provide all other items required by the temp service item 992-11-009, including paragraphs

• 3.5 through 3.5.1

• 3.7 through 3.7.4

• 3.8 through 2.8.1 (contractor will be required to install and maintain their service lines One inch in diameter and larger and mooring lines as required by 009-69)

• 3.10 through 3.10.1

• 3.11 through 3.11.7

• 3.18 through 3.18.1.1

• 3.22 through 3.22.6

• 3.25 through 3.25.12

• 3.26 through 3.26.4

• 3.27 through 3.27.1

The pier differential includes the costs estimated to be incurred by the Navy for shore power, potable & non-potable water, sewage and oily waste. The costs for the T-1 line and the hook up or set up for these elements were considered de minimis and so were not included in the pier differential.

Contractors may use the pier for laydown, from the bow to the stern of the ship, from the fire line to the piers edge. Offerors should not assume that any additional space/facilities will be provided. The offeror is reminded that the following elements must be placed in the allotted pier laydown area:

• HAZMAT containers listed in item 992-11-002 (1,840 Square feet).

• Reefer Boxes listed in item 992-11-007 (7,680 Square feet).

• Small boat storage listed in item 992-11-011 (2,000 Square feet).

156. The RFP lists the interport differentials that shall be proposed for offerors that do not plan to perform the proposed work at the USS MAKIN ISLAND’S homeport of San Diego, CA. These differentials are stated to be calculated using foreseeable costs for fuel, towing and pilot charges, and travel to the offeror's facility by applicable Government personnel. It is unclear whether or not the interport differentials account for all costs which are foreseeable with reasonable certainty, which is the standard that GAO has held is appropriate. For example, are costs associated with the vessel's crew, such as travel allowances, dedicated transportation to and from the homeport, or permanent change of station allowances, included within the interport differential? Are the differential costs for Alteration Installation Teams (AITs) travel and shipping of material and equipment included? When these and other factors are considered, the current interport differentials do not appear sufficient to account for all the foreseeable costs that will be incurred by the Government.

Please clarify the methodology of the foreseeable cost calculations and include all real costs that will be incurred by performing the USS MAKIN ISLAND DPMA outside of the homeport area by providing a concise breakdown of each of the various costs that are included in the inter-port differential calculation, for each location (Portland, San Diego and San Francisco).

a. RFP Amendment 4 revises the “Inter-port Differential” paragraph in Section M to state, “…calculated using foreseeable costs for fuel, towing and pilot charges, and travel to the contractor’s facility by applicable Government personnel (Management, Oversight, Assessment, Survey, Certification, and Ship’s Force (to include relocation, sustainment, and crew training costs)).” Alteration Installation Teams (AIT) are not considered in the Interport Differential calculation.

157. In Questions and Answers #1, the response to question 11 noted that work item 857-11-002, “Temporary Off-Ship Berthing Equivalent to BOQ/BEQ; provide (Option Item)”, was included in the specification package but not listed in “J-4_Pricing_Workbook_MAKIN_ISLAND_RFP_v3”. The response to this question states that “This item was removed under ERRATA 1 and is not part of the Solicitation.”

However, from review of this work item, it is clear that it was meant to provide the necessary accommodations for the ship’s crew members for an availability outside of the homeport area. Based on the standard Government per diem rates of $151 for Portland and $267 for San Francisco, this cost can expected to be approximately $35,000,000 for Portland and approximately $60,000,000 for San Francisco. As these amounts exceed the provided interport differentials, they are clearly not included within it.

In order to ensure full and proper accountability for all foreseeable costs associated with accomplishing this availability outside of the homeport area, work item 857-11-002 should be included in the solicitation package as part of CLIN 0006 or the provided interport differentials should be very significantly increased.

a. Work item 857-11-002, “Temporary Off-Ship Berthing Equivalent to BOQ/BEQ; provide (Option Item)” was removed because it was redundant to costs for temporary off-ship berthing already accounted for in the interport differential. Work Item 857-11-002 will not be included in the package.

158. Contractor requests the calculation method of obtaining the interport differentials listed in the solicitation.

Location*Differential
Portland, OR$16,716,178
San Diego, CA$175,851

San Francisco, CA $37,254,322

a. In regard to the calculation method of obtaining the interport differentials, please see Questions and Answers number 156 response above.

159. In reference to “Standard Item 009-72,” RFP, Section L, VOLUME I, page 80, “009-72 Supporting Price Information” requires submittal of other than cost and pricing information sufficient for the Contracting Office to validate the offerors price associated with completing the requirements of 009-72. This requirement appears to be an inadvertent hold-over from a cost-type contract and not necessary or applicable for a fixed priced contract. Please either delete the requirement for 009-72 supporting price information from sections L and M or provide specific clarification on what would be considered sufficient pricing information under a fixed priced solicitation.

a. Concur. The requirements for other than certified cost and pricing data for Standard Item 009-72 was removed from RFP Section L, M, and Attachment J-4. However, the requirements of this Standard Item, as it relates to individual Work Items, are still applicable to this Availability.

160. Sections L and M provide a pier differential for Offerors proposing to accomplish pier-side work at NAVSTA, San Diego. Although not stated in Section M as being included, please confirm that crane service, that for an availability of this size and scope, could total between $1.5- $2M, is not included in this differential.

a. In regard to the Pier Differential, the Navy confirms that Crane Services are not included in the Pier Differential calculation.
