About this file
This is a Commercial Single Source Justification memorandum for a federal acquisition at or below the Simplified Acquisition Threshold (SAT), dated August 2026.
The procurement covers comprehensive membership, accreditation, training, and certification services for the NAVFAC EXW Mobile Utilities Support Equipment (MUSE) Division from the InterNational Electrical Testing Association (NETA), located at 30500 Northwestern Highway, Suite 110, Farmington Hills, MI 48334. The contract establishes and maintains a NETA Approved Military Organization (NAMO) program and includes annual membership dues for up to 60 sailors, administrative support, ANSI/NETA certification exam administrations (three attempts per sailor including practice exams), Continuing Technical Development credit tracking, and access to over 70 online technical seminars and 130 webinars. Additional deliverables include 10 hard copies and an intranet PDF multi-user license for ANSI/NETA standards (ATS, MTS, ECS, and ETT); quarterly shipments of 10 copies of NETA World Journal; 2 sets of NETA Technical Handbooks; 6 fully covered registration packages to the annual PowerTest Electrical Maintenance and Safety Conference; and coordinated onsite technical training with instructor expenses included. The performance period runs from January 1, 2027 through December 31, 2029 (three years), with an optional provision to add sailors in groups of five at a flat rate per group. The justification identifies NETA as the sole source based on restrictive rights (exclusive proprietary rights and copyrights to ANSI/NETA standards and examinations), exclusive licensing agreements (NETA is the sole administrator of the NAMO program with no authorized resellers), and other reasons (NETA is the premier certification standard required for OSHA compliance for qualified electrical testing personnel, and failure to approve would result in loss of MUSE Division accreditation and operational capability gaps).

III. THE DECISION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
IS BASED ON THE FOLLOWING:
A. X ONLY ONE SOURCE AVAILABLE (select all that apply):
1. X RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
The InterNational Electrical Testing Association (NETA) is an ANSI-accredited standards developer and holds exclusive proprietary rights and copyrights to the ANSI/NETA electrical testing standards (ATS, MTS, ECS, and ETT) and their corresponding examinations. NETA is the sole developer, copyright holder, and administrator of these examinations, study guides, and the NETA World Journal. No other commercial vendor or training provider is legally permitted or technically capable of licensing these standards, administering NETA certification testing, or issuing official NETA Certified Technician credentials.
2. X EXCLUSIVE LICENSING AGREEMENTS.
The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
NETA is the sole organization that administers and governs the NETA Approved Military Organization (NAMO) program, which is specifically designed to allow military organizations like the NAVFAC EXW MUSE Division to maintain organizational accreditation and certify active-duty personnel. NETA does not utilize third-party distributors, authorized resellers, or external training representatives to sell, administer, or manage NAMO program memberships, credentials, or certifications. All elements of this requirement must be procured directly from NETA as the sole source and developer.
3. X OTHER REASONS.
The NAVFAC EXW MUSE Division provides critical mobile utility support to Navy and joint facilities worldwide, which requires operating and testing high-voltage electrical systems. These technicians must be certified as qualified personnel under federal safety regulations, specifically supporting the Occupational Safety and Health Administration (OSHA) requirements for qualified electrical testing personnel. NETA is the premier and universally recognized certification standard in the electrical testing industry.
If this sole-source procurement is not approved, the MUSE Division will be unable to maintain its NAMO accreditation, leading directly to the expiration of technician certifications. This would prevent Navy technicians from legally or safely testing high-voltage power grids, resulting in an immediate operational capability gap, halting critical infrastructure projects, and severely impacting military mission-readiness and safe
B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.
C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government.
The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified:
2. Required delivery date/period of performance:
3. Explanation of why delivery/commencement of services by the date mentioned above is required:
4. If appropriate, include any additional pertinent information.
IV. CERTIFICATIONS/APPROVALS:

Signature Name (Printed) / Phone # Date
