1 Department of Labor (DOL) Appropriations Act of 1995

The DOL Appropriations Act of 1995 contains the following language:

“None of the funds appropriated in this title for the Job Corps shall be used to pay the compensation of an individual ... at a rate in excess of $196,700." (The compensation amount is updated periodically. This is the most current rate.)

The current schedule for compensation cost for 2011 (Executive Rates Level I) is $96.01 per hour ($199,700 / 2080 hours). This is the rate we need to evaluate for 2011. The maximum compensation rate is updated periodically and can be found at www.opm.gov/oca/09tables/html/ex.asp.

According to the Act, the Compensation Cost for an individual must not exceed the allowable rate in order to be fully reimbursable. However, Compensation Cost is not defined as the full rate paid to the vendor. Instead, “compensation” is defined as “salaries and cash bonuses exclusively.” Compensation Cost does not include many other costs incurred by the vendor (insurances, licensing, transportation, materials & supplies, etc.). Also, the Act applies to “individuals,” not companies, partnerships, clinics, or other groups. The contract will be paid according to the Total Hourly Rate, and the breakdown is for MTC/DOL purposes only.
Example: If you plan to submit an hourly rate of $100, a breakout of $75 for Compensation Cost and $25 for Estimated Overhead & Other Costs would equal the Total Hourly Rate. An itemized list or having to prove the costs that are included in overhead is not required.
You will be paid according to the Total Hourly Rate, not the Compensation Cost rate. Checks will not show the breakout of the two costs nor will the breakdown be communicated to the Internal Revenue Service.
If you have any questions, please contact the procurement agent. Thank you.
