About this file

This document is an attachment detailing specifications and additional terms for a Michigan Statewide Educational Network (MiSEN) FY2025 Data Center Presence procurement. MiSEN is seeking to maintain data center presence and access to regional Tier 3 Data Centers, specifically at two 123.NET locations - DC4 in Byron Center and DC1 in Southfield, MI. The services requested include rack space (1-3 contiguous racks), power circuits, PDUs, smart hands service, and cross-connect options at both locations. The contract term is for two years beginning July 1, 2025, with seven one-year renewal options, potentially extending the total term to nine years. Service providers must meet specific requirements including SSAE-18 SOC2 Type II certification, CJIS, HIPAA, and PCI-DSS compliance.

The procurement is eligible for E-Rate funding, and implementation is dependent on MiSEN's written Notice to Proceed and funding availability. Service Level Agreements must meet 99.99% network availability, less than 0.25% frame/packet loss, sub-10ms network latency, and 20ms network jitter commitments. The contract includes a service credit schedule for outages, ranging from 5% to 50% of the Monthly Fiber Maintenance Fee based on outage duration. Providers must respond to outages within two hours and restore service within four hours. No price increases are allowed during the contract term for quoted NRC costs and MRC rates, though provisions exist for adjustments related to new U.S. government tariffs on imports.

ATTACHMENT A - Specifications & Additional Terms FY2025 MiSEN Data Center Presence

Background The Michigan Statewide Educational Network, LLC or MiSEN is tasked with providing for the long-term sustainability of Michigan’s Statewide Education Network (SEN) to achieve K12 connectivity across the State of Michigan. The ultimate purpose of the SEN is to connect all Intermediate School Districts (ISDs) and, through their ISD WANs, connect all Local Education Agencies (LEAs, Public School Districts), Libraries, and Public School Academies (PSAs) in the state, which, in turn, connect the administrative, instructional, and support staff at each of these locations including over 1.4 million students across the state.

SEN Transport

MiSEN operates a Statewide Educational Network (SEN) currently connecting fifty-eight (58) SEN Nodes throughout Michigan and two (2) regional ISP data centers. The SEN is a fully managed, leased-lit transport service provided by Merit Network, Inc. (Merit); MiSEN’s current network transport provider.

The SEN consists of 40 Gbps, 100 Gbps, and 200 Gbps WAN core backbone services that deliver 10 Gbps to 100 Gbps LAN transport service to its SEN Nodes.

SEN Internet Access Services

MiSEN offers its consortium members Internet Access (IA) and Distributed Denial of Service (DDoS) protection services, provided by 123.NET at two data center locations, DC1 and DC4. Internet and DDoS protection services are currently provisioned at 200 Gbps at DC1 and 100 Gbps at DC4. A 4 x 100G LAG handoff between Merit and 123.NET is present at both data centers. In the event of an outage at one data center, the SEN is protected with full failover capability; either data center can provide 300 Gbps of IA and DDoS protection services.

Project Scope MiSEN is soliciting unit cost pricing and proposals for services and costs associated with access to regional Tier 3 Data Centers and maintaining a Data Center presence. These services might include, but are not limited to rack space, power, cross connections, peering opportunities, and Data Center to Data Center connections.

For all services, turn-key solutions with all expected costs are required. Service must begin on July 1, 2025, which represents the start of the 2025-26 E-Rate funding year.

Requested Contract Term MiSEN requests a contract term for a two (2) year base service contract with an option for seven (7) additional renewal periods of one (1) year each. Contracts must begin on or after July 1 and end June 30 of the following year to coincide with the E-Rate funding year, e.g., 7/1/25 – 6/30/27, 7/1/27 – 6/30/28.

The total contract term, if all extensions are exercised, will be nine (9) years.

General Terms for All Proposals Description of Proposal

● Respondent will provide a description of all services being proposed.

● MiSEN reserves the right to award all services in this procurement to a single provider or split the award between multiple providers to seek the overall most cost-effective solution.

● Description will include an overview of the proposal, any deviations from the requested architecture, design or requirements, assumptions made, and other details MiSEN may find useful or necessary (or could differentiate the solution from a competing proposal).

Timeline

For each response, respondents must include a detailed timeline for bringing the service offerings online by July 1, 2025. This should specify whether the services will be managed internally or subcontracted, particularly in the context of renting rack space in major data centers.

References

For each response, respondents must provide 3 references from current or recent customers with projects equivalent or comparable to the needs of MiSEN that include:

● Contact name

● Name and address of organization

E-Rate Program Integrity Assurance (PIA) Review

If their solution is chosen, respondents are required to promptly provide MiSEN or its consultant with any information being requested as part of PIA review.

Vendors may assist applicants with preparing funding requests or responding to PIA questions and may speak directly with PIA reviewers.

By submitting their bid, respondents agree to provide all requested construction labor, materials, and cost information during the PIA review process.

Required Notice to Proceed and Funding Availability

MiSEN will follow the purchasing policies of its governing board and the requirements and procedures of the FCC’s E-Rate program as administered by the Universal Service Administrative Company to be eligible for all available funding.

The implementation of any associated contracts resulting from this competitive bid process will be dependent on MiSEN’s issuance of a written Notice to Proceed.

E-Rate funding notification and or submission of an FCC Form 486 will not signify a Notice to Proceed.

MiSEN will have the right to allow the contract to expire without implementation if appropriate funding does not become available.

Service Level Agreements Offerors must provide their own SLAs with their responses for solutions. The following standards are what MiSEN will compare bidder’s submitted SLAs against:

● The provider will make all reasonable efforts to ensure 99.99% network availability of each circuit.

● Less than.25% frame/packet loss commitment

● Sub 10ms network latency commitment for the leased lit fiber transport circuit measured between the Z location and the A location

● 20ms network jitter commitment

● There is no right of provider to limit or throttle the capacity of the circuit at any time for any reason

● These standards are a vendor-stated commitment for fully operating service. Any degradation of service may be counted against the network availability standard.

● Vendor will provide monthly service reports and an annual service report showing peak link usage for the quarter and downtime on the link

● Ad-hoc reporting, which may be necessary for State and Federal program participation, as needed

● Impaired performance versus SLA standards for the link

● These are all aggregate statistics for the month

MiSEN is asking a bidder for their commitment to respond to any outage within two (2) hours and a four

(4) hour restoration of service (see schedule of service credits below), with credits for a greater than 2-hour response to a service outage.

Length of Service Outage Credit is the following percentage of Monthly Fiber Maintenance Fee

Less than 2 hours No Credit Two (2) hours to four (4) hours 5% Greater than four (4) hours and less than 10% eight (8) hours Greater than eight (8) hours and less than 15% twelve (12) hours Greater than twelve (12) hours and less than 20% sixteen (16) hours

Greater than sixteen (16) hours and less 35% than twenty-four (24) hours

Greater than twenty-four (24) hours 50%

All contracts must include a provision permitting early termination of service, with no penalty, should a location be closed. Additionally, if MiSEN moves its demarcation point to a new location, the final agreement must include a provision permitting that site to be added at the existing MRC rate for the duration of the contract, with MiSEN paying for any one-time charges associated with the move. Any additional or new sites added to the agreement will be co-terminus with the main agreement.

No increased pricing will be allowed during the term of the quoted NRC costs and MRC rate. Service providers proposing prices may increase, depending upon new U.S. government tariffs imposed on imports, are encouraged to (a) identify such products in their offers, and (b) propose an acceptable methodology for limiting price adjustments over the life of the contract. Subject to contract restrictions, services may be reevaluated for cost-effectiveness at any time during the life of the agreement, including renewal periods.
