About this file

This document is a Memo to Offerors regarding RFP 24-0401 for a Water Sewer Master Plan issued by the City of Fredericksburg, Virginia. The memo notes that the language under the "AWARD" section in the original RFP incorrectly referenced the negotiation and award method. The correct process is for the city to engage in individual discussions with two or more fully qualified, responsible, and suitable offerors, with an emphasis on professional competence, to provide the required services. At the conclusion of discussions, the city shall select the offerors deemed most meritorious based on the published evaluation factors and negotiate a contract, beginning with the offeror ranked first. If a satisfactory and advantageous contract cannot be negotiated with the first-ranked offeror, negotiations will proceed with the offeror ranked second, and so on, until an acceptable contract can be negotiated at a fair and reasonable price.

The related state and local contract opportunity is for a Water Sewer Master Plan in the City of Fredericksburg, Virginia. The contract is being procured through a competitive Request for Proposal (RFP) process.

March 15, 2024 Reference RFP ##24-0401 Water Sewer Master Plan

In review of our recent Request for Proposal, we noted under the Offeror Eligibility Requirements and Qualifications Section, Item 7 “AWARD,” the language references the incorrect negation and award method. The City shall engage in individual discussions with two or more offerors deemed fully qualified, responsible and suitable on the basis of initial responses and with emphasis on professional competence, to provide the required services.

At the conclusion of discussion, on the basis of evaluation factors published in the Request for Proposal and all information developed in the selection process to this point, the public body shall select in the order of preference two or more offerors whose professional qualifications and proposed services are deemed most meritorious.

Negotiations shall then be conducted, beginning with the offeror ranked first. If a contract satisfactory and advantageous to the public body can be negotiated at a price considered fair and reasonable and pursuant to contractual terms and conditions acceptable to the public body, the award shall be made to that offeror. Otherwise, negotiations with the offeror ranked first shall be formally terminated and negotiations conducted with the offeror ranked second, and so on until such a contract can be negotiated at a fair and reasonable price.
