About this file
This is a Justification and Approval memorandum for a sole-source procurement submitted by the National Institutes of Health (NIH) Clinical Center, Department of Laboratory Medicine. The NIH seeks to procure one-year on-site maintenance services for a BD FACSCanto II Flow Cytometry Cell Analyzer (Serial #V96100699) with attached FACSLoader (Serial #F06500302) and one computer workstation from Becton Dickinson Company, located at 155 North McCarthy Boulevard, Milpitas, California 95035. The total contract value is $25,617.60.
The service contract includes comprehensive maintenance coverage for both instruments: two preventive maintenance inspections annually with PM kits, 24-hour guaranteed emergency response Monday through Friday (excluding BD Biosciences holidays), software revisions during the agreement term, unlimited service visits five days per week, and unlimited telephone support for instruments, reagents, and applications. The FACSCanto II coverage encompasses labor, travel expenses, and parts excluding consumable items and printers; the FACSLoader coverage similarly includes labor, travel expenses, and parts excluding consumables. The justification for sole-source procurement is based on Becton Dickinson being the manufacturer and sole provider of maintenance services for these specific instruments, which is critical for maintaining validated test systems necessary for clinical diagnostics and patient care at the NIH Clinical Center. Market research confirmed no alternative vendors can provide equivalent service for these instruments.

It is critical that that identical instrument service be in use to ensure that test systems already validated in lab can be smoothly maintained, allowing standardization across many test systems and instruments in lab.
OTHER FACTS SUPPORTING
In accordance with FAR 6,303-2(iii), the nature of harm that would be brought to NIH CC patients may result in delayed diagnosis and treatment. Having validated test systems available in the department is an asset but only insofar as the adequacy of the associated supplies and the purpose they serve. Scientists and physicians alike depend on the efficiency and proficiency at which we test for the patients who come here from around the world with the trust that our NIH CC clinicians can assess and treat patients thoroughly and at the highest clinical expertise.
