About this file

This is a Tree Removal Permit issued by the Department of Regulatory and Economic Resources, Environmental Resources Management Division in Miami-Dade County, Florida, for the City of Doral's "Landmark at Doral Traffic Calming" project located in the right-of-way of NW 66th Street from NW 102nd Avenue to NW 107th Avenue. The permit (TREE-2400763) was issued on February 19, 2025, and is valid through February 19, 2027. The approved work includes removal of 500 square feet of tree canopy, relocation of 1,600 square feet of canopy from four non-specimen trees (2 Conocarpus erectus, 2 Phoenix dactylifera), and after-the-fact removal of 1 Conocarpus erectus. All work must be performed in accordance with the Tree Disposition Plan prepared by Stantec and approved by the Division of Environmental Resources Management on February 18, 2025, and signed by Professional Engineer Carlos M. Herdocia.

The permittee must comply with comprehensive tree mitigation and protection requirements, including replanting a minimum of 500 square feet of tree canopy using Florida No. 1 grade or better replacement trees in accordance with the approved Landscape Plan prior to permit expiration. A mitigation bond of $840.00 is required—$640.00 for tree relocation and $200.00 for canopy replacement—to ensure compliance with landscape plan implementation. Additional obligations include removing all prohibited plant species, constructing and maintaining protective barriers around remaining trees, adhering to ANSI A-300 standards for all tree-related work under supervision of an ISA Certified Arborist, and ensuring relocated trees survive for one year from final inspection or providing replacement trees. The permittee must obtain a local building permit from the City of Doral and notify the project manager when replanting is complete to schedule final inspection with two weeks' notice. Failure to comply with permit conditions may result in enforcement action, bond forfeiture, withholding of certificate of occupancy, and penalties under Miami-Dade County Code.

SPECIAL PERMIT CONDITIONS

TREE CANOPY MITIGATION REQUIREMENTS

1. To mitigate for the loss of tree canopy, the permittee shall replant 500 ft² of tree canopy credit. All replacement trees shall have a minimum quality of Florida No. 1 Grade or better.

2. Replanting shall be performed in accordance with the Landscape Plan entitled "City of Doral, Landmark at Doral Traffic Calming", sheet No.T-01, prepared by Stantec, digitally signed and sealed by Carlos M. Herdocia, P.E.47660, as received by the Tree and Forest Resources Section on 2/13/2025.

3. Replanting shall be consistent with the site sketch and species list provided. Any changes to the canopy replacement location or species list shall be approved in writing by DERM. Failure to submit an as-built signed and sealed Landscape Plan for changes to the tree replacement prior to permit expiration may result in enforcement action, and may forfeiture of a portion of the mitigation bond.

4. Replanting shall take place prior to the permit expiration date or completed within a time frame approved by

DERM.

5. Replanting must be completed, verified and approved by DERM. The applicant shall notify the DERM project manager when the replanting is complete and schedule a final inspection (two weeks' notice is required). A mitigation bond in the amount of $840.00 shall be posted to ensure implementation of the landscape plan and compliance with the canopy replacement requirements of this permit. The landscape trees must become established in the landscape prior to the release of the bond funds.

6. Failure to satisfy all canopy replacement requirements may result in enforcement action. Notwithstanding the canopy mitigation requirements of this permit, the landscape material shall be installed and maintained in accordance with the minimum landscape requirements of the Code of Miami-Dade County and the Landscape Manual.

7. The permittee shall obtain a Building permit from the local municipality prior to the removal of trees.

TREE PRESERVATION REQUIREMENTS

8. The following trees are to remain: Trees outside of the scope of work located at the above referenced project location.

T 305-372-6567 F 305-372-6407 miamidade.gov

TREE PROTECTION REQUIREMENTS

9. Protective barriers shall be constructed around each tree or cluster of trees prior to the commencement of construction activities on-site. The protective barriers shall be constructed of wood, plastic or metal and shall be a minimum of four (4) feet above ground level. The protective barriers shall be placed extending from the tree trunk of any protected tree or cluster of trees no less than the critical root zone of the tree (approximately the distance between trunk and drip line of the tree or six (6) feet (radius distance), whichever is greater. Protective barriers shall be in place prior to the start of any construction, must remain in place until development is completed and DERM has authorized their removal.

10. During all site work and construction, no soil, vehicles, heavy equipment (such as bulldozers or backhoes), fill, building materials, construction debris, or dead vegetation shall be placed, stored, or deposited within the areas protected by barriers, nor shall there be disposal of any waste material such as paints, oils, solvents, asphalt, concrete, mortar or any other material harmful to trees or understory plants within the areas surrounded by protective barriers. Natural grade shall be maintained within protective barriers. If the natural grade of the site is changed because of site development such that the health or safety of the tree(s) may be endangered, tree wells or retaining walls will be required.

11. All tree related work shall be performed in accordance with the most recent ANSI A-300 standard Practices for Tree Care Operations, Parts 1, 2, 5, 6, 8 and their companion Best Management Practices issued by the International Society of Arboriculture (ISA). Canopy and/or root pruning should be performed under the supervision of an ISA Certified Arborist.

12. Improper tree trimming that includes, but is not limited to, top pruning (sometimes referred as hat-racking or topping), may result in the effective destruction of trees. Effective destruction is defined in Chapter 24 of the Code of Miami-Dade County as "the girdling, or damaging of a tree trunk, branch or root system, or cutting, pruning or trimming not done in accordance with the most recent ANSI A-300 Standard Practices for Tree Care Operations.

Effectively destroyed trees have an increased risk of failure and may become a hazard to persons or property.

Effective destruction of regulated trees is prohibited unless prior written approval has been obtained from DERM.

13. Fences and walls shall be constructed to avoid disturbance to any protected tree(s). Post holes and trenches located close to the tree(s) shall be dug by hand and adjusted as necessary, using techniques such as discontinuous footings, to avoid damage to major roots.

14. Underground utility lines shall be placed outside the areas surrounded by protective barriers. If placement is not possible, disturbance shall be minimized by using techniques such as tunneling or overhead utility lines.

15. All work shall be conducted in a manner that avoids adverse impacts to the remaining and/or relocated trees (including their critical root zone) depicted in the Landscape Plan reviewed by DERM.

TREE RELOCATION REQUIREMENTS

16. A tree relocation plan on the Tree Disposition Plan entitled "City of Doral, Landmark at Doral Traffic Calming", sheet No. T-02, prepared by Stantec, has been approved by the Tree and Forest Resources Section. The applicant agrees to implement this plan when relocating the trees subject to this permit.

17. Any relocated tree that dies or in the opinion of DERM becomes nonviable within one (1) year from the final inspection date shall be replaced according to the standards set forth in Section 24-49.4 (2)(c) of the Code of Miami-Dade County. Replacement shall take place within three (3) months of the tree(s) dying or within three (3) months of notice from DERM that the tree(s) is nonviable. A prorated contribution can be made to the Tree Trust Fund to mitigate for trees that do not survive the relocation. A portion of the mitigation bond for $640.00 corresponds to the canopy value of the proposed relocation. The success of the tree relocation must be verified and approved by DERM prior to the release of its value from the bond being held on this project.
