About this file

This document is a minimum insurance requirements template for the Massachusetts Bay Transportation Authority (MBTA). The file establishes mandatory insurance coverage that contractors must maintain throughout the contract term and any extensions. The requirements encompass three primary insurance categories: Commercial General Liability Insurance with limits of $1,000,000 per occurrence and $1,000,000 annual aggregate, written on an occurrence basis with a policy endorsement deleting exclusions for work within 50 feet of rail; Automobile Liability Insurance covering all owned, leased, hired, and non-owned vehicles with combined single limits of $1,000,000; and Workers' Compensation Insurance including Employers Liability Insurance with minimum limits of $1,000,000 for each accident, $1,000,000 per employee for disease, and $1,000,000 aggregate policy limit for disease-related claims. All insurance policies must be placed with Massachusetts Division of Insurance-licensed carriers maintaining a Best's rating of A- or better.

All required insurance coverage must be obtained before contract commencement and maintained throughout the contract term as primary and non-contributory to MBTA self-insurance. Contractors must provide certificates of insurance at contract inception and continuously throughout the term, naming the MBTA as an additional insured and documenting that required limits are in effect. All subcontractors must provide equivalent insurance coverage for their operations. Carriers must provide the MBTA with at least 30 days advance written notice of any policy cancellation. Workers' Compensation Insurance must include a waiver of subrogation rights against the MBTA. The template includes placeholder fields for bid number and project name completion.
