About this file

This is a contract terms document for the Maine Military Authority (MMA), establishing the general conditions for a one-year contract to supply Basic Issue Item Tools in support of the agency's vehicle and equipment refurbishment and maintenance operations. The contract will be executed through a delivery order system, with specific orders transmitted via email to the vendor's primary contact. MMA reserves the right to issue multiple orders simultaneously with varying delivery dates, and shipments will only be accepted up to two weeks in advance of stated delivery dates without prior approval. Orders not delivered as scheduled are subject to modification or cancellation at MMA's discretion. The State Purchasing Director retains the right to extend the contract beyond the indicated expiration date with contractor consent and to cancel the contract with thirty days' written notice.

Bid prices must be submitted as net F.O.B. destination with all transportation and delivery charges fully prepaid by the contractor and will remain fixed throughout the contract period unless periodic price changes are formally agreed upon in writing. The State of Maine reserves payment flexibility through multiple methods including check, electronic funds transfer (EFT), and procurement card; however, state statute (9-A MRSA 8-303(2)) prohibits vendors from imposing surcharges on credit or debit card transactions. MMA's preliminary shipment schedule, if provided, represents an estimate of needs and may be adjusted based on actual operational requirements at the time orders are placed.
