Industry Question Gov't Response

1 What is the timeline for actual solicitation for NEXGEN MCCUU release

The first week of May.

In place of the 10-linear yards of MCTCU fabric, would it be possible to supply sewn uniforms made from tropical-weight fabric that have been treated with our FR technology?

No, uniforms will not be accepted in the place of fabric linear yards.

If the answer to question-3 is no, does the 10-linear yards have to be a continuous piece of fabric? (i.e. can we supply two pieces of 5 linear yards)

No, the ten linear yards of fabric does not need to be continuous. Two pieces is acceptable.

Our laundering durable FR-technology does not greatly affect the SWIR reflectance of the current MCTCU. In saying this, would it be possible to ask you if there have been other respondents to this solicitation who have expertise in SWIR reflectance, but are looking to enhance the FR-properties of the fabric? If so, may you please put us in contact with them?

We cannot provide industry contacts.

Berry Compliance - This RFP and subsequent FUE appears to fall below the $250,000 Berry Compliance threshold. Will non-Berry solutions be accepted for evaluation if supplier can provide confirmation that future production would be fully Berry compliant for any programs in 2024 and beyond? What kind of paperwork would be required for solicitation submissions?

Yes. The Defense Appropriations and Authorizations Acts and other Statutes

(including what is commonly referred to as the “Berry Amendment”) imposes restrictions on the DOD’s acquisition of foreign products and services. A preference for certain domestic commodities is required by 10 USC 2533a and

DFARS 252.225-7012. These references require the Department of Defense to acquire specific end items or components that have been grown, reprocessed, reused, or produced in the United States. Items provided under this solicitation and the resulting contract shall be compliant with the above references, as applicable. The Contractor shall maintain additional documentation substantiating the claim that all materials, including components and raw materials, submitted under this solicitation and the resultant contract are Berry

Amendment Compliant, as applicable. The Contractor shall be able to provide this documentation to Government personnel upon request.

If vendors Headquarters are OCONUS and all products are 100% manufactured in the US, will it preclude them from any Barry

Amendment stipulations?

No. As long as the products are manufactured in the US.
