Section G - Contract Administration Data
G.1 Travel
(a) Area of Travel. Performance under this contract may require travel by contractor personnel. If travel, domestic or overseas, is required, the contractor is responsible for making all necessary arrangements for its personnel. These include but are not limited to: medical examinations, immunizations, passports/visas/etc., and security clearances.
(b) Travel Policy. The Government will reimburse the contractor for approved travel costs incurred by the contractor in performance of the contract in accordance with FAR Subpart 31.2. Travel required for tasks assigned under this contract will be governed in accordance with: Federal Travel Regulations, prescribed by the General Services Administration for travel in the conterminous 48 United States, (hereinafter the FTR); Joint Travel Regulation, Volume 2, DoD Civilian Personnel, Appendix A, prescribed by the Department of Defense, for travel in Alaska, Hawaii, The Commonwealth of Puerto Rico, and territories and possessions of the United States (hereinafter JTR); and Standardized Regulations (Government Civilians, Foreign Areas), Section 925, "Maximum Travel Per Diem Allowances for Foreign Areas," prescribed by the Department of State, for travel in areas not covered in the Federal Travel Regulation or the Joint Travel Regulation.
(c) Travel. Travel and subsistence are authorized for travel beyond a fifty-mile radius of the normal work location. The normal work location is specified in Section 3.1.9 of the Base Contract PWS.
Contractor employees authorized by the contractor to telework from a location that is either within, or beyond, their normal work location’s local commuting area will not be reimbursed for travel expenses for travel to the normal work location. Travel performed for personal convenience, in conjunction with personal recreation, or daily travel to and from work will not be reimbursed.
(1) For travel costs other than described in the preceding paragraph (c) the contractor will be paid on the basis of actual costs to the extent that travel is necessary for the performance of services under the specific task order and is in accordance with paragraph (f) of this Section.
(2) When transportation by privately owned conveyance is authorized, the contractor will be paid on a mileage basis not to exceed the applicable Government transportation rate as contained in the JTR. Distances traveled between points will be shown on invoices as listed in standard highway mileage guides. Reimbursement will not exceed the mileage shown in the standard highway mileage guides.
(3) The contractor agrees, in the performance of necessary travel, to use the lowest cost mode commensurate with the requirements of the mission as set forth in the basic contract and in accordance with good traffic management principles. When it is necessary to use air or rail travel, the contractor agrees to use coach, tourist class, or similar accommodations to the extent consistent with the successful and economical accomplishment of the mission for which the travel is being performed.
(4) The contractor’s invoices shall include receipts or other evidence substantiating actual costs incurred for authorized travel. In no event will such payments exceed the rates of common carriers.
(d) Car Rental. The contractor will be reimbursed for car rental, exclusive of mileage charges, as authorized in the basic contract or upon approval by the COR, when the services are required to be performed beyond the normal commuting distance from their normal work location. Per the JTR, a second car will not be authorized unless there are more than four persons traveling.
(e) Per Diem. The contractor will not be paid for per diem for contractor personnel who reside in the metropolitan areas in which the tasks are being performed. Per Diem will not be paid on services performed within a fifty-mile radius of the contractor’s home office (e.g., teleworkers) or the contractor’s local office. Per Diem will be paid to the contractor only to the extent that overnight stay is necessary and authorized under this contract. The authorized per diem rate will be the same as the prevailing per diem in the worksite locality. These rates will be based on rates contained in the JTR. The applicable rate is authorized at a flat seventy-five (75%) percent on the day of departure from contractor’s home or local office, and on the day of return. Reimbursement to the contractor for per diem will be limited to actual payments of per diem defined herein. The contractor shall provide actual payments of per diem defined herein. The contractor shall provide supporting documentation for per diem expenses, as defined herein, as evidence of actual payment.
(f) The COR must approve ALL travel prior to occurring. All travel shall be requested IAW Base PWS paragraph 3.1.11.
(g) The Government will not reimburse the Contractor for travel costs incurred beyond funding provided in each task order.
G.2 Limited Authority of Government Personnel
No modification, statement, or conduct of Government personnel who might visit the Contractor’s facility or in any other manner communicate with Contractor personnel during the performance of this contract will constitute a change under the “Changes” clause of this contract.
No understanding or agreement, contract modification, change order, or other matter deviating from or constituting an alteration or change of the terms of the contract will be effective or binding upon the Government unless formalized by contractual documents executed by the Contracting Officer.
The Contracting Officer is the only person authorized to approve changes in any of the requirements of this contract and, notwithstanding provisions contained elsewhere in the contract, the said authority remains solely with the Contracting Officer. In the event that the Contractor effects any change(s) at the direction of any person other than the Contracting Officer, these change(s) will be at the Contractor’s expense. No adjustment will be made in the contract price or other contract terms and conditions, if the Contracting Officer did not approve consideration for the aforementioned unauthorized changes.
G.3 Non Personal Services
The Government will neither supervise contractor employees nor control the method by which the contractor performs the required tasks. The Government will not assign tasks, nor prepare work schedules for individual contractor employees. The contractor shall manage its employees and guard against any actions that give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute, personal services, it shall be the contractor's responsibility to notify the Procuring Contracting Officer (PCO) immediately.
G.4 Withholdings
Government withholding, as described herein, is not the Government's sole remedy for the failure of the contractor to perform in accordance with the Acceptable Quality Level (AQL) and contract terms. Any withheld amount does not serve as a limitation of liability for the contractor, and does not limit the contractor's obligation to perform. The Government reserves the right to pursue all legal remedies available in addition to withholding, and expressly reserves its right to withhold amounts and additionally pursue other remedies to include, but not limited to, termination for default.
In the event that the contractor fails to meet the performance requirements for the specific tasks as set forth in the below table, payment to the contractor shall be withheld. The rate of withholding is as follows:
