Answers to Offeror Questions dated 03 Jan 2018 Attachment J.28

Question Number

Discussion Question Response

1 Defense Base Act (DBA) insurance is a requirement for overseas work. It is the overseas equivalent of Workers’ Compensation insurance. The Govt. did not include the FAR clause in the RFP, but it should have been included due to the Okinawa work. DBA costs are usually billed as an ODC.

Will the Govt. include FAR 52.228- 3 for Defense Base Act insurance in the RFP and allow contractors to bill the costs for this insurance as an ODC for the work performed in Okinawa?

In accordance with FAR 28.309, FAR Clause 52.228-3 is prescribed in solicitations and contracts when the Defense Base Act applies (see 28.305) and --

(1) The contract will be a public-work contract performed outside the United States; or

(2) The contract will be approved or financed under the Foreign Assistance Act of 1961 (Pub.L.87-195) and is not excluded by 28.305 (b)(2).

Accordingly, FAR 52.228-3 does not apply because this is not a public-work contract, nor is it funded through the Foreign Assistance Act of 1961.

2 When employees are stationed overseas for long periods without their families, they are often provided a monthly Family Separation Allowance. A commonly offered one is $250 per month.

Will the Govt. allow a monthly Family Separation Allowance billed as an ODC for personnel performing work in Okinawa without their families present?

The Government will not reimburse Family Separation Allowance as a separate line item under ODC’s. Should an Offeror make the business decision to include such an Allowance, it shall be rolled into the proposed labor rate.

3 L.3.b.5 of the solicitation state “each volume shall contain a title page, table of contents, and list of tables and figures for that volume.”

Is this matrix a ‘stand alone’ document in its own binder? Or may we add the PWS cross reference matrix along with the table of contents, list of tables and figures?

The Cross Reference Matrix may be included in the Technical Volume or in a separate binder.

4 Reference Attachment J.18. The excel table referenced has columns for the months April 2018 through February 2019.

These dates do not coincide with the base year, 26 April 2018 to 25 April 2018 from the pricing

Should we change the months to reflect the base year?

Attachment J.18 reflects the period of performance of the first task order (April 2018 – February 2019), as indicated in Section L.5 of the solicitation. The first task order period of performance is different than the ordering periods identified in Section F of the solicitation.

Therefore, Offerors are not expected to provide data in Attachment J.18 beyond February 2019.

spreadsheet requirement, these years are not in the TEEP calendar, it is a different year, and it is only 11 months.

5 Amendment 4 was just released and now requires compensation plans from the principal subcontractors and coordination for sealed packages. It will be difficult to meet the January 8 suspense given these new requirements were just announced, team member companies are scattered across the country, and the current proposal due date is near. Also, given that most companies will hand deliver the proposals, we feel a 1 week extension would greatly help (due ~16 Jan).

Will the government grant an extension, and thereby, adjust the due date from 8 Jan to 16 Jan?

The Government will not provide an extension to the proposal due date.

6 The 25 page limit for compensation plans seems too restrictive. Normally, there is not a page limit to compensation plans, and given the overseas positions and requirement for “supporting documentation such as recognized national and regional compensation surveys and studies of professional, public and private organizations, used in establishing the total compensation structure,” we

Would the Government consider removing the 25 page limit on the compensation plans, and making it "no limit"?

The Government will not increase the page limit of the Compensation Plan volume.

request a change to “no limit” for the compensation plans.
