2200 LESTER STREET

QUANTICO, VIRGINIA 22134-6050

Code: CT 2.5 J&A Number: 17,706

Code: CT 2.5 J&A Number: 17,706

JUSTIFICATION AND APPROVAL (J&A)

TO PROCURE USING BRAND NAME SPECIFICATION(S)

Upon the basis of the following justification, I, as Contracting Officer for the procuring activity, hereby approve the issuance of the contractual action described herein using Brand Name Specifications, pursuant to the authority of Federal Acquisition Regulation (FAR) 11.105.

BRAND NAME JUSTIFICATION

1. Contracting Activity

Marine Corps Systems Command PM 115 Combat Support Systems PdM Engineer Systems 2200 Lester Street Quantico, VA 22134-6050

2. Description of the Action Being Approved

Award of a Firm Fixed Price (FFP) contract to procure Xtreme Telehandler Model XR2450EC to support the operational capability of the Marine Corps Chemical Biological Incident Response Force (CBIRF). The telehandler must meet the following requirements:

- Capacity: 20,000 lbs

- Max Lift Height: 50 ft

- Max Lift Weight: 9000 lbs

- Forward Reach: 36 ft

- Foam Filled Tires

- 2.0 Cubic Yard Bucket

- Man Basket/Work Platform

- Swing Carriage and Lifting Hook

- Heavy Duty Forks and Carriage.

As stated in the market research, detailed below, the only model currently available in the commercial marketplace is made by Xtreme. Xtreme has at least three U.S. and two Canadian resellers listed on its website from which the Government can procure the required item.

3. Description of Supplies/Services

The proposed contract action is to procure one (1) Xtreme Telehandler Model XR2450EC, associated training and initial provisioning items.

4. Statutory Authority Permitting Other Than Full and Open Competition

The statutory authority for items peculiar to one manufacturer is FAR 11.105(b)(c), DFARS 211.105, and FAR 6.302-1(c), Application for brand name descriptions. FAR 6.302-1(c) permits the use of brand name description in the acquisition if it is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

5. Rationale Justifying Use of Cited Statutory Authority

The Telehandler is the only unit commercially available that has the capability to meet requirements required by the CBIRF. The Telehandler Model XR2450EC meets the following requirements:

- Capacity: 20,000 lbs

- Max Lift Height: 50 ft

- Max Lift Weight: 9000 lbs

- Forward Reach: 36 ft

- Foam Filled Tires

- 2.0 Cubic Yard Bucket

- Man Basket/Work Platform

- Swing Carriage and Lifting Hook

- Heavy Duty Forks and Carriage.

The requirement for Telehandler Model XR2450EC was identified via a Letter of Clarification to the Urgent Statement of Need (USON) #12041UA validated through the requirements process and mandated by a Headquarters Marine Corps letter signed by the Director, Capabilities Development Directorate dated September 25, 2013. In the letter it is noted that the Extended Boom Fork Lift (EBFL) is inadequate for use by the CBIRF. In the event of an on-call mission, the CBIRF requires the ability to respond in an acceptable amount of time at full operational and strategic levels. Given CBIRF’s mission to respond as an on-call force at the strategic level in support of either the Department of Defense (DOD) or Department of Homeland Security (DHS). Additionally, CBIRF supports Northern Command’s (NORTHCOM)CONPLAN 0500, the President of the United States (POTUS) at State of the Union Addresses and is deployable for worldwide mission.

Currently the CBIRF does not have the capability to lift an object over 4,000 lbs with the boom extended out farther than 24ft. Current Marine Corps assets that are similar in nature, the Marine Corps Extended Boom Forklift (EBFL) only has a maximum capacity of 11,000 lbs and a maximum reach of 30ft. Current assets do not have the ability to move and/or manipulate heavy debris using a telehandler during real world operations and would rely solely on the support of other DOD entities and/or local agencies. If the equipment is not readily available there would be a need to rent the equipment on an urgent basis at additional costs and delay to the mission. The acquisition of the telehandler is critical in supporting CBIRF’s disaster response capability in the National Capital Region.

While there are several commercial telehandlers in various sizes and capabilities, no other commercially available product meets the approved requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

An RFI was posted to FedBizOpps on February 21, 2014 asking for vendors to state their ability to meet the requirements listed in the USON. Responses were received from four (4) vendors stating their capabilities on February 28, 2014. One vendor stated they could provide an item which met the requirements. None of the other vendors who submitted a response were able to meet the requirements with any other telehandler. The Contracting officer will publish a combined synopsis/solicitation on FedBizOpps providing notice of the Government’s intent to procure this specific item. The solicitation will be made full and open to all parties who can provide the Xtreme Telehandler XR2450EC.

7. Determination of Fair and Reasonable Cost

The Contracting Officer will determine the anticipated cost to the Government of the product covered by this J&A will be fair and reasonable in accordance with FAR 12.209, Determination of price reasonableness. The Contracting Officer’s determination of fair and reasonable pricing will be based on an analysis of the proposed prices submitted through the competitive marketplace. If required, the Independent Government Cost Estimate (IGCE) will also be used in relation to the proposed price.

8. Actions to Remove Barriers to Future Competition

This is a one-time buy and no further acquisitions are anticipated.
