(b) Prohibition. Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L.

115-91) prohibits Government use of any covered article. The Contractor is prohibited from--

(1) Providing any covered article that the Government will use on or after October 1, 2018; and

(2) Using any covered article on or after October 1, 2018, in the development of data or deliverables first produced in the performance of the contract.

(End of clause)

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) (TAILORED)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The proposed acquisition is 100% Set aside for Small Business. The associated North American Industry

Classification System (NAICS) code is 541614, Document Preparation Services, which has a small business size standard of 15.0 Million dollars in annual receipts.

The Government anticipates award of a Requirements Type contract, in accordance with Far 16.503. The quantities specified in the schedule are estimates only and do not commit the Government to these exact quantities. Task orders will be issued against the contract and will specify the exact items and quantities to be ordered.

PERIOD OF PERFORMANCE (POP):

https://dibnet.dod.mil/ https://dibnet.dod.mil/

*or from the effective date of award for a period of 12 months with two 12 month option periods*

BASIS OF AWARD. The Government intends to award to the quoter who represents the Lowest Price Technically

Acceptable (LPTA) quote.

Quotes will be evaluated and ranked according to price, from lowest to highest. The Government reserves the right to evaluate only the technical quote of the lowest price quoter. Other technical quotes may not be evaluated unless the Government determines the lowest price quoter to be unacceptable or non-responsive. In the event the

Government determines the lowest price quoter to be unacceptable, the technical quote of the next lowest price quoter will be evaluated. This process will continue until a technical proposal is determined to be acceptable.

EVALUATION: Quotes will evaluated in an efficient and minimally burdensome manner per FAR PART 13.106.

The Contracting Officer reserves the right to evaluate quotes without the use of formal evaluation procedures such as establishing a competitive range, conducting discussions, and scoring quotations. The Government intends to evaluate quotes and award a contract without conversations with vendors. Contractors should not expect requests for clarification or additional information from the Government. Therefore, the contractor’s initial quote shall contain the contractor’s best terms from a price and technical standpoint. The contractor’s quote must be written in a logical, practical, clear, concise, and logically assembled manner, containing all pertinent information in sufficient detail to provide the evaluators with a clear understanding of the contractor’s approach and to permit the evaluation of the proposed program. It is the responsibility of the contractor to present enough information to allow the various efforts, support, and management approach to be evaluated without conversations. The contractor’s initial quote should contain the contractor’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct conversations with contractors, as necessary, if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; and may waive informalities and minor irregularities in quotes received.

The criteria for evaluation are:

1) Technical Capability – The offeror’s technical and management approach shall, at a minimum, address each of the following factors separately, as they apply to the Performance Work Statement (PWS). All offerors’ quotes will be evaluated using the following criteria.

• Subfactor A: Services shall be available 24 hours a day/7 days a week/365 days a year.

• Subfactor B: Turnaround time from audio upload to returned document shall be no longer than 24 hours.

Transcription files cannot be emailed or faxed

• Subfactor C: Contractor shall provide security protocols that at a minimum include authentication, authorization, and encryption (minimum of 256 bit SSL) via password protected URL or Secure Web download.

• Subfactor D: The contractor shall provide typists that:

o are based in the United States;

o have passed an employment screening that includes criminal background checks at the federal, state, and local levels; and o signed a Nondisclosure and Confidentiality Agreement

2) Period of Perfromance: Clearly state ability to meet the Period of Performance start date of 17 September 2018.

The first task order will be issued at the time that contract is awarded

3) Past Performance: A review of the vendor's record in the Past Performance Information Retrieval System

(www.ppirs.gov) will be conducted. Vendors must have a rating of Exceptional, Very Good, Satisfactory, or

Marginal. In the case of an offeror without a record, or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.

4) Price.

INSTRUCTIONS FOR PREPARATION OF QUOTES:

Vendors responding to this announcement shall submit their quote in accordance with FAR 52.212-1. Quotes submitted shall include the following:

1) Technical Capability . The quote must include a comprehensive and expanded explanation of how each of the

Subfactors A-D would be satisfied. Merely restating the PWS requirement is not acceptable.

2) Period of Performance : Contractor’s ability to provide services during the required time period

3) Price: The price quote shall reflect unit prices, extended amounts per line item, and overall total.

(Note: All prices must be actual “face-value” pricing having already accounted for any discounts offered and extended to the Government). All quotes submitted shall be the Contractor’s Best Quote as it is the Government’s intent to make award based on the original quotes received

4) Completed FAR provision 52.212-3 Alt 1 – The offeror shall complete only paragraphs (b) of this provision if the

Offeror has completed the annual representations and certification electronically via the System for Award
