The Bidder warrants by submitting a bid that, as a result of examination and investigation of all the aforesaid data, the Bidder can perform the Work in a good and workmanlike manner and to the satisfaction of the Owner. The Owner assumes no responsibility for any representations made by any of its employees, officers or agents during or prior to the execution of a Contract, unless (1) such representations are expressly stated in the Contract, and (2) the Contract expressly provides that the responsibility therefor is assumed by the Owner.

Owner will issue a Notice to Proceed. The receipt of the Notice to Proceed will be authorization for Contractor to begin Work in the field and to start ordering equipment and material.
FAILURE TO EXECUTE CONTRACT OR SUBMIT INSURANCE
Failure by a Bidder to whom the Work is awarded to execute the Contract and file acceptable bonds and certificates of insurance coverage and endorsements as provided herein shall be just cause for the cancellation of the award and the forfeiture of the bid security, and shall make the Bidder liable to Owner for all damages resulting from the failure, including reasonable attorney’s fees.
