About this file
This is a Brand Name or Equal Justification and Approval document for the procurement of 93 Non-Tactical Vehicles (NTVs) by the 411th Contracting Support Brigade in Korea for the Eighth Army (8A). The acquisition will be an LCS-funded firm-fixed price contract limited to Korean contractors licensed to do business in the Republic of Korea.
The procurement includes five different vehicle types: Hyundai Staria Diesel Cargo Van (11 passenger), Hyundai Sonata Smart Stream Gasoline Sedan (5 passenger), Kia K5 Prestige Gasoline Sedan (5 passenger), Hyundai Palisade Gasoline SUV (7 passenger), and Kia Sorento Diesel SUV (7 passenger). The justification allows for brand name or equal items that meet the salient characteristics detailed in Solicitation W91QVN25R0007. Market research conducted from July 10 - December 31, 2024 identified seven possible sources. The vehicles will replace existing NTVs that have exceeded their operational efficiency and maintenance expenditure limits. The contracting officer anticipates competition but will determine fair and reasonable pricing using FAR 13.106-3 methods if competition is not present.

Brand Name or Equal Justification and Approval Under FAR 13.501
1. Contracting Activity: 411th Contracting Support Brigade, Korea, ATTN: CCSB- KOH-HD, Unit #15289, APO AP 96271-5589
2. Description of Action: 8A G4 requests an LCS-funded firm-fixed price contract to purchase 93 Non-Tactical Vehicles. The acquisition is a ROK MND funded LCS contract which limits award to “Korean contractors”, which means a contractor that is licensed and/or registered to do business in the Republic of Korea. This new requirement is to be awarded through open market competition. The resulting award shall be Firm-Fixed Price and will be funded by CY25 LCS fund.
3. Description of Supplies/Services:
CLIN Manufacturer Model Name 0001 Hyundai Staria, Diesel Cargo Van, 2.2 engine (11 pax) 0002 Hyundai Sonata, Smart Stream, Gasoline Sedan, 2.0 engine (5 pax) 0003 Kia K5 Prestige, Gasoline Sedan, G2.0 engine (5 pax) 0004 Hyundai Palisade, Gasoline SUV, 3.8 V6 engine (7 pax) 0005 Kia Sorento, Diesel SUV, VGT 2.5 engine (7 pax)
4. Authority Cited: Pursuant to 41 USC 1901, as implemented in FAR 13.501(a)(1)(ii) and in accordance with Section 888(a) of the National Defense Authorization Act for Fiscal Year 2017 (Pub. L. 114-328), this justification is required to use brand name or equal descriptions.
5. Reason for Authority Cited: The salient characteristics for this requirement are firm and can be found on pages 7 through 11 of Solicitation No. W91QVN25R0007, which is associated with this justification. The government requires that any offered item contain features that meet or exceed the salient characteristics. The recommended manufacturer and model have been confirmed to meet the specified salient characteristics and fulfill the required specifications and characteristics for 8A. This ensures that the recommended product supports the non-tactical vehicle transportation needs and accommodates the requirements of rotational units arriving for diverse operational and training purposes. Other items may be accepted, provided they meet the salient characteristics listed in the aforementioned solicitation. In addition to the brand name/model requested, there is a general description of the items, as well as salient physical characteristics of the brand name item that an "equal" item must meet to be acceptable for award. The salient characteristics are firm requirements, but not overly restrictive, allowing for competition.
These vehicles are life-cycle replacement non-tactical vehicles that have exceeded their operational efficiency and are no longer capable of reliably supporting our mission requirements. The current fleet has reached a critical juncture, where the cost of repairs
