About this file
This is a Labor and Material Payment Bond form for the City of Jackson, Michigan, designed to ensure contractor compliance with payment obligations to subcontractors and material suppliers on public works projects. The bond is executed in compliance with Public Act No. 213 of the Public Acts of Michigan of 1963, as amended, and serves as a financial guarantee tied to a specific construction contract between the Principal (contractor) and the Owner (City of Jackson). The bond requires the contractor to pay or cause payment to all subcontractors, persons, firms, and corporations providing labor or materials in connection with the contract work. The bond amount, contract date, contract description, and execution date are to be filled in by the parties at the time of agreement.
The bond structure holds the Principal and Surety jointly and severally liable for all payment obligations, with the liability remaining unaffected by any changes, alterations, modifications, or extensions to the underlying contract terms. The Surety's obligation is waived of notice requirements regarding contract modifications, ensuring that the bond remains enforceable even if contract terms are adjusted. The form requires execution by authorized officers of both the Principal and Surety, with the Surety's signature requiring an attorney-in-fact designation and attachment of a Power of Attorney document. This bonding requirement applies to the 626 N East Street electrical repair project, which the City of Jackson Community Development Department is offering through competitive sealed bidding to qualified homeowners with proper licensing and Sam.gov registration.
