About this file

This is a Request for Proposal (RFP) issued by the University of Wyoming Trademark Licensing Office (UWTLO) and the State of Wyoming (SOW) seeking a Wyoming-based distillery to develop a co-branded whiskey featuring the Bucking Horse and Rider trademark. The RFP was released on July 18, 2024, with supplier questions due by August 5, 2024, and proposal responses required by August 21, 2024, at 2:00 PM MDT. The project aims to create a nationally recognizable whiskey that tells the story of Wyoming's heritage and the University of Wyoming, with anticipated supplier presentations in September 2024 and a full product rollout planned for Fall/Winter 2024. The standard contract term is five years, subject to mutual agreement and satisfactory performance.

The RFP specifies comprehensive requirements for potential distillers, including mandatory submissions of TTB and state permits, detailed business proposals covering company overview, financial status, whiskey style, distribution plans, production capabilities, brand integration strategy, and community engagement. Evaluation will be based on a 380-point scoring system across nine criteria, with weights ranging from 6 to 10 points for areas such as distribution plan, production capabilities, and whiskey packaging. The selected partner will be expected to develop a royalty-bearing licensed product, with the specific royalty structure to be proposed by the distiller. The University reserves the right to reject any proposals and will own all intellectual property related to the submitted materials.

SECTION III

SCOPE OF WORK

A. INTRODUCTION

1. Purpose

a. The University of Wyoming Trademark Licensing Office (UWTLO) and the State of

Wyoming (SOW) are jointly issuing this Request for Proposal (RFP) to select a Wyoming-based distiller with strong communication, branding, marketing, production and distribution capabilities to help design, develop, curate, produce, market and distribute an award-winning and regionally recognizable whiskey.

b. The proposal is to produce a co-branded product (i.e., the distillery brand and the university brand) to tell the story (the history, pride and tradition) of the Bucking Horse and Rider (BH&R) and the University of Wyoming (UW), while enhancing and promoting the UW brand and the distillery brand on a regional and national level.

2. History

a. For over a hundred years, the Bucking Horse and Rider trademark has represented a rich tradition in the State of Wyoming. Use of this image dates to World War I, when the insignia was used by the Wyoming National Guard as a means of identification on trucks, guns and helmets, a reminder of home and a symbol of the west. In the 1920s, the University of Wyoming athletic department placed the Bucking Horse and Rider mark on its athletic uniforms. In 1935, Secretary of State Lester Hunt proposed legislation to make changes to the Wyoming license plate design. The proposed changes were constructed to combat Wyoming's wide-spread issue of counterfeit license plates. In 1936, Wyoming's uniquely designed license plate containing the Bucking Horse and Rider made its debut and it has been there ever since.

b. In the early 1990s, there was an increased demand for commercial use of the mark. This prompted the SOW and the UW to join, create legislation and protect the mark to ensure that its ownership is rightfully retained by Wyoming, for the people of Wyoming.
