About this file

This is a Limited Sources Justification for a Federal Supply Schedule (FSS) order under FAR Part 8.405-6, issued by the Department of Veterans Affairs Network Contracting Office 16 in Houston, Texas.

The acquisition involves a three-year service plan and maintenance agreement for a ScriptPro Robotic Prescription Dispensing System currently in use at Overton Brooks VA Medical Center, covering the period October 1, 2026, through September 30, 2029. This is a re-procurement of a prior service agreement (GSA Order 36F79719D0135-36C25622F0063) that was effective from October 1, 2021, through September 30, 2026. The proposed contractor is ScriptPro USA Inc., located in Mission, Kansas, operating under FSS Contract 36F79719D0135. The services include maintenance, software licensing, firmware updates, diagnostic utilities, and malfunction repairs for the prescription dispensing system and its associated components, including SP 200/CCC platforms, Enterprise HCI platforms, workflow management software, inventory management modules, pharmacy portals, datapoints, printers, kiosks, and various interface controllers and encryption systems.

The justification relies on FAR 8.405-6(a)(1)(B)—sole source authority—establishing that only ScriptPro possesses the proprietary knowledge, specialized tools, and authorized access to the system's encrypted communication protocols and diagnostic utilities necessary to perform maintenance and repairs at the required quality level. The OEM has confirmed that unauthorized maintenance voids the warranty and compromises system integrity and patient-safety safeguards. GSA has already negotiated fair and reasonable pricing under the existing FSS contract. The VA will monitor the marketplace and reassess competitive alternatives upon system end-of-life to evaluate whether new vendors become authorized or capable of providing ScriptPro-compatible services. No market research was conducted among other schedule holders because no other vendors can legally access or service the proprietary system; use of an alternate contractor would require complete system replacement at an estimated cost of approximately $2.1 million.

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized:

The proposed contractor and OEM maintains sole ownership and control over all proprietary software, diagnostic utilities, firmware, and encrypted communication protocols used in the ScriptPro Prescription Dispensing System (PDS). No third-party entity is authorized or technically capable of accessing or modifying these functions.

The OEM has confirmed in writing that unauthorized maintenance or software interaction will void the existing warranty and could compromise system integrity, patient-safety safeguards and medication dispensing workflow. Due to the highly specialized nature of the PDS architecture and the need to interface seamlessly with existing inpatient pharmacy workflows, only the OEM possesses the specialized tools, trained personnel, and proprietary knowledge required to perform maintenance, updates, and repairs at the required level of quality.”

FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order

VHAPG Part 808.405-6 Limiting Sources Page 4 of 6

Acquisition ID#: 36C256-27-AP-0326 was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

FAR 8.405-6(b): Items peculiar to one manufacturer:

A patent, copyright or proprietary data limits competition. The proprietary data is:

These are “direct replacements” parts/components for existing equipment.

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:

GSA has already negotiated fair and reasonable pricing for ScriptPro OEM services under the awarded FSS contract. Because no other vendor is authorized or capable of performing the required services, and because improper servicing would jeopardize system operation and warranty protections, acquiring these services directly from the OEM represents the most efficient and cost-effective means of ensuring continued safe dispensing operations. OEM servicing eliminates the risk of system failure, reduces lifecycle costs, and preserves the Government’s prior investment in the PDS infrastructure

(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.

Service can only be accomplished by ScriptPro employees and technicians. There are no other vendors who can access or service these items. ScriptPro has no 3rd party access for pharmaceutical dispensing systems. Since no other vendors can service the existing system, use of an alternate contractor would require new system acquisition. The requiring activity estimates a full system replacement would cost approximately $2.1M; therefore, use of an alternate contractor would result in a duplication of cost that could not be recovered through competition.

(7) Any Other Facts Supporting the Justification: None

(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
