About this file

This is a Justification for Other Than Full and Open Competition (J&A) for a sole source contract award to Design and Production Incorporated (D&P). The National Archives and Records Administration (NARA) seeks to restrict competition and award a contract to D&P for recurring bi-monthly preventative maintenance and ad-hoc repair services for four museum exhibits at the National Archives Building located at 700 Pennsylvania Avenue in Washington, DC: The American Story, Discovery Center, Records of Rights, and the Orientation Plaza. The preventative maintenance services include on-site inspections of electric systems, control room system functionality, large display device operation, touch screen calibration, and audio-visual system integrity. Ad-hoc repair services address reported malfunctions and monthly structural inspections of mechanical components including slide rails, sliding panels, drawers, and interactive exhibit elements, with immediate verbal reporting of any issues that could cause harm or failure.

NARA justified the sole source award based on D&P's proprietary ownership of the complex control system that integrates power, video, audio, lighting, and interactive computers throughout the exhibits, as well as D&P's special software program that connects to Archives I's emergency announcement system. Market research confirmed that D&P preventative maintenance and ad-hoc repair services are only available through D&P, Inc., and no other authorized or certified resellers exist. A Notice of Intent to Sole Source was posted on SAM.gov to solicit capacity statements and pricing data from potential sources. The contracting officer determined anticipated costs would be fair and reasonable based on an Independent Government Cost Estimate, with pricing to be inclusive of option years. NARA indicated that when the D&P control system reaches end-of-life, alternative technical systems capable of integration will be researched and competed.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Exhibits Preventative Maintenance and Ad-hoc Repairs for the National Archives Museum

I. IDENTIFICATON OF THE AGENCY AND THE CONTRACTCNG ACTIVITY, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A "JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION".

See Page 1.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

The National Archives and Records Administration (NARA) intends to restrict competition to Design and Production Incorporated (D&P) to provide recurring bi-monthly preventative maintenance and ad-hoc repair services for The American Story, Discovery Center, Records of Rights, and the Orientation Plaza which are exhibits of NARA in the National Archives Building, located at 700 Pennsylvania Avenue, in Washington, DC.

Ill. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEED (INCLUDING THE ESTIMATED VALUE).

NARA intends to restrict competition to D&P for recurring bi-monthly preventative maintenance and ad-hoc repair services for The American Story, Discovery Center, Records of Rights, and the Orientation Plaza exhibits located at the National Archives Museum in Washington, DC. The preventative maintenance and ad-hoc repair services are required to keep the exhibits operable and maintain the high level of service expected by DC museum visitors and congressional leaders.

The preventative maintenance and additional services will include the following services:

Bi-monthly on-site preventative maintenance service will focus on inspecting all installed electric systems; address any reported malfunctions to the COR, respond to questions or concerns during each visit; check and confirm control room system functionality, operation of all large display devices, calibration of all touch screen displays, and integrity of all audio-visual systems for health and safety among other services.

Monthly on-site preventative maintenance of exhibit structures will focus on checking and confirming all mechanical movements - slide rails, sliding panels, drawers, and all other interactive exhibit componentry; checking and confirming all exhibits for structural integrity, health and safety, natural or unnatural wear and tear, or other damage and provide an immediate verbal report of any issues that may cause harm or failure to the exhibit; and notify the NARA COR if parts or services are needed at an additional expense among other services.

IV. AN IDENTIFICATION OF THE STATUTORY AUIBORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION.

The procedures in FAR Subpart 13.5 were used in accordance with 41 U.S.C. §190I Simplified Acquisition Procedures.

V. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUIBORITY CITED.

D&P, Inc. includes proprietary configurations that can only be supported by the owner/developer. D&P as the owner/developer of the complex and robust control system that ties power, video, audio, lighting, and interactive computers, owns all rights to the sale, support and distribution of the D&P systems. Due to the proprietary nature of the control system which is also tied into Archives I's emergency announcement system that runs via a special software program written by D&P, NARA cannot reasonably compete this requirement as an other than brand name. D&P products.

VI. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER

5.202 APPLIES.

A Notice of Intent to Sole Source, with this J&A, will be posted in SAM.gov encouraging responsible sources an opportunity to submit their capacity statement, pricing data, and other information, which shows a bona fide ability to meet the requirement.

VII. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERI\1MENT WILL BE FAIR AND REASONABLE.

The proposed price will be determined fair and reasonable based on an Independent Government Cost Estimate (IGCE) developed by NARA and price inclusive of option years.

V. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED.

NARA conducted market research for authorized/certified resellers of D&P preventative maintenance and ad-hoc repairs for D&P's control system and determined the D&P preventative maintenance and ad-hoc repairs are only available through D&P, Inc.

When the D&P control system reaches end-of-life, NARA's Museum Programs Division will research other technical systems that will integrate within NARA's Museum system. In the meantime, currently continuing annual preventative maintenance and ad-hoc repairs are the most cost effective solutions for the exhibits at the National Archives Museum. D&P has not provided any current end-of-life estimates for the D&P control system.

IX ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION.

None.

X. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN TUE ACQUISITION.

None

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED.

NARA will continue to monitor the market for optional control systems capable of fulfilling its requirement.

XIl. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER'S KNOWLEDGE AND BELIEF.

See Page I.
