About this file
This document is a Justification for Brand Name Exception to Fair Opportunity, specifically for FEMA's Continuity Division (CCD) to procure Cisco networking equipment. FEMA intends to award a task/delivery order under the NASA SWEP V contract for Integrated Continuity Communications Transport (ICCT) network equipment upgrade, specifically Cisco WebEx Desk Minis to End of Life (EOL) equipment with DX-70s and DX-80s. The procurement is valued under $750,000 and is a small business set-aside. The justification emphasizes the need for Cisco equipment due to FEMA's existing network architecture, which uses a proprietary Cisco IOS XE software architecture, and the agency's current SMARTNET service support contract. The document highlights that using non-Cisco equipment would require network reconfiguration and potentially create interoperability issues that could compromise system support efficiency.

Justification for Brand Name Exception to Fair Opportunity Exceeding the SAT pursuant to FAR 16.505(a)(4)
FEMA network architecture, maintenance platforms, and configuration systems require the use of this product to ensure interoperability with other FEMA systems at all data centers. FEMA CCD’s ICCT network use a proprietary software architecture that is specific to Cisco IOS XE Software. Follow-on hardware acquisitions must meet the same format of Cisco IOS XE or Cisco IOS XR software platforms to maintain interoperability.
Currently, FEMA CCD has a service support contract (SMARTNET) with Cisco which covers all of our other Cisco devices in our network. If we purchase anything other than Cisco we would have to reconfigure our network. The CISCO products must be configured in accordance with FEMA OCIO system architecture requirements. The use of other products could result in interoperability, compatibility, interface issues that would preclude the system’s support team from providing efficient and effective customer support.
5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer determines that the anticipated price(s) will be fair and reasonable based on past and current similar costs associated with CISCO products and services throughout the government.
6. Any other facts supporting the justification.
None.
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
None.
8. FEMA intends to post this justification on SAM.gov pursuant to FAR 16.505(b)(2)(ii)(D).
9. Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for an exception to fair opportunity) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
10. Technical/Requirements Personnel Certification.
Pursuant to FAR 16.505(b)(2)(ii)(B)(9), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the justification, are accurate and complete.
