Appendix B SAP Single Source Justification
FAR 13.501
SECTION I: Introduction
The Aviation and Transportation Security Act was signed into law on November 19, 2001. TSA employs more than 45,000 security screeners and provides guidance and training to flight crews for dealing with threats on-board aircraft. Since February
17, 2002 TSA has been responsible for all civil aviation security functions. Because these tasks are directly related to the security of the national air transportation system, TSA has a critical need to be located on or very near airport property. TSA’s
Real Estate Management Division and Office of Acquisition propose to enter into a contract on the basis of other than full and open competition.
The Aviation Transportation Security Act (ATSA – P.L. 107-71 Sect. 600.1; 49 U.S. Code § 114) provides TSA with the authority to enter into contracts, including leases.
The Transportation Security Administration (TSA), Transportation Security Administration Training Center (TSATC) and
Direct Leasing Branch propose to solicit and issue a purchase order based on soliciting only one source. (FAR 13.106-1 (b)(2))
The Direct Leasing Branch J&A tracking number is JA-RELD-25-0007.
This acquisition is conducted under FAR Part 13, Simplified Acquisition Procedures.
SECTION II: Description of Action Being Approved
TSA’s Real Estate Management Division - Direct Leasing Branch proposes to enter into a contract on the basis of other than full and open competition. Using FAR Part 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements and FAR Part 13, Simplified Acquisition Procedures, DLB will be compliant in utilizing the prescribed simplified acquisition procedure. This contract is for the repair and replacement of the inoperable Action Target Inc. firing range target and projectile recovery systems components located at the Transportation Security Administration Training Center
(TSATC) in Egg Harbor Township, NJ.
Action Target, Inc.
Firm Fixed Price Contract
NTE $105,000 (with options)
Period of Performance: 90 days
SECTION III: Description of Supplies or Services
Action Target, Inc. is the original manufacturer and installer of the proprietary firing range target control equipment used on the
TSATC ranges to support centralized training and law enforcement training, required by law. The following Firing Range
Target Systems and Projectile Recovery systems are broken and in need of urgent repairs. The manufacturer is the only available source which provides the necessary components, parts, services and follow-on support after installation:
TASK:
The Transportation Security Administration (TSA) requires the services of a qualified contractor to provide all labor, materials, tools, and equipment necessary to replace 100% of the targeting control components within its training systems. These systems include MAC valves, pistons, target actuators, and associated pneumatic tubing, all of which are essential for the synchronized movement of targets used in TSA personnel training. The current components have become unreliable and must be removed and replaced with new, fully operational parts that are completely compatible with the existing infrastructure. The contractor shall ensure that all installed equipment, including pneumatic tubing, integrates seamlessly with current systems and that all targets move in unison without lag or desynchronization following installation.
Under this contract, the contractor will be responsible for the complete removal and compliant disposal of all existing MAC valves, pistons, target actuators, and pneumatic tubing. New components must be installed to meet or exceed the operational specifications of the original system. The contractor must perform comprehensive testing and calibration to confirm that the new system functions as required. Post-installation, the contractor will provide TSA with detailed testing results and documentation that outlines the new system configuration, as well as a complete list of installed components. All new
SAP Single Source Justification components—including MAC valves, pistons, actuators, and pneumatic tubing—and labor provided under this contract must be covered by a minimum one-year warranty.
Estimated Contract Value $105k
SECTION IV: Identification of the Single Source Justification
FAR 6.302-1(c)(1)
Only one source is capable of responding due to the unique or specialized nature of the work.
Brand Name Only. Note: if using “brand name”, clearly explain why brand name or equal is not a viable solution.
An urgent and compelling need exists and soliciting more than one vendor would result in unacceptable delays.
A licensing agreement is required as a part of this purchase order, which is available from only one source.
SECTION V: Description of Rationale
The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) implemented by the FAR
Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements”.
Action Target, Inc. is the Original Equipment Manufacturer (OEM) and installer of turnkey indoor and outdoor firing range equipment at the Transportation Security Administration Training Center (TSATC) in Egg Harbor Township, NJ, as well as other TSA operated ranges. Their steel bullet trap has become the gold standard within the industry because of its ability to successfully collect bullet rounds, lead dust, and other particles in a way that is eco-friendly and low maintenance for TSA.
This already proprietary and highly specialized equipment has been customized and modified for FAMS training use, and as such, no other commercial source can provide the system and components without substantial duplication of costs to replace the existing infrastructure and systems. The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Standardization across TSA ranges is for the benefit of training and staff consistency, interoperability, environmental, safety and liability concerns. The use of a different vendor for this effort will result in very high risk to TSA as no vendor has products available as a commercial off the shelf (COTS) replacements for the components needing repair and replacement under this effort. Components and other system parts provided under this effort need to remain interchangeable across all TSA operated ranges to maintain the Government’s ability to interchange parts between ranges during any given training event. In addition, Action Target parts purchased are customized for the TSA and FAMS program specific needs and installed in an environmentally and OSHA compliant manner.
The work on the projectile recovery system involves work on a hazardous material recovery system involving lead and heavy metals. An alternate vendor must engineer a custom solution as a repair, resulting in additional delivery time to an already critically needed repair. In addition, the vendor must have experience with hazardous material recovery systems in the firing range industry to avoid a potentially hazardous materials spill with subsequent environmental, health, and safety consequences.
SECTION VI: Contracting Officer’s Determination that the Order Represents the Best Value
No OEM warranties are currently in effect. However, the use of an alternate vendor and their custom engineered repair to
Action Target’s equipment would be significantly costlier to the Government and could have a detrimental effect resulting in failure of range systems, poor performance of the system equipment using non-compatible/non-standard components, and a longer repair time of the custom parts in the future. These combined could result in range downtime, longer repair times, serious injuries to staff, extended delays to the FAMS training schedule, and higher repair costs. For these reasons, the
Government requires a turn-key repair of the firing range target systems and projectile recovery systems through Action Target.
41 U.S.C. 253(c)(1) FAR 6.302-1(A)(ii)(A) or (B) states that circumstances permitting other than full and open competition include situations that would cause “substantial duplication of cost to the Government that is not expected to be recovered through competition or unacceptable delays in fulfilling the agency’s requirements.”
SECTION VII: Market Research Description
Market research online via search engines and SAM.gov, yielded several commercial entities (xSteel Targets, InVeris, Range-
Systems) offering firing range systems with both target and lead retrieval components. However, none openly provided customizable and interchangeable target or replacement parts and components to support the Action Target infrastructure currently installed at the TSATC. The proprietary nature of the software utilized and control boards installed precludes engagement with other entities for the repairs necessary.
