Exhibit 2 In order to assure that all contracts for Janitorial/Custodial services are in compliance with Homeland Security Presidential Directive-12 (HSPD-12), and that the contractor and contractor employees (employees who will require access to the government facility) have successfully completed background investigations and received a LincPass (an identification card used to access the contract facility), the Clauses and Statements listed in full text below are added to this contract.

Contractors are required to identify all employees who will have routine access to the contract facility for a period of six months or more, and provide each employee with the attached Person Model Information Sheet. This is the first step in the process of contractor and contractor employees obtaining a LincPass. The contractor shall gather the Person Model Information Sheets and submit them, in one batch, to the Personal Identity Verification Sponsor identified below. The identified employees will then be contacted by the government and required to complete electronic fingerprinting and photo (at a Government Credentialing Center), hardcopy finger printing and a Questionnaire for Non-Sensitive Positions. Employees who receive clear background investigations will receive notification to go to a Government Credentialing Center for LincPass activation and pickup. They may then continue working on the contract; employees who do not receive clear background investigations are subject to immediate removal from working on this contract per AGAR 452.204-71 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR

EMPLOYEES.

The government is charged a fee for each background investigation completed so contractors should only submit Person Model Information Sheets for the minimum number of employees required to work on this contract.

When the Person Model Information Sheet is completed, it must be delivered to Chris Hansen at the Utah Acquisition Support Center (UASC). Clause: FAR 52.204-9 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR PERSONNEL (JAN 2011)

(a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24 and Federal Information Processing Standards Publication (FIPS PUB) Number 201.

(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:

(1) When no longer needed for contract performance.

(2) Upon completion of the Contractor employee’s employment.

(3) Upon contract completion or termination.

(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.

(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor’s employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.

Clause: AGAR 452.204-71 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR EMPLOYEES (OCT 2007)

(a) The Contractor shall comply with the personal identity verification (PIV) policies and procedures established by the Department of Agriculture (USDA) Directives 2620-002 series.

(b) Should the results of the PIV process require the exclusion of a Contractor’s employee; the Contracting Officer will notify the Contractor in writing.

(c) The Contractor must appoint a representative to manage compliance with the PIV policies established by the USDA Directives 4620-002 series and to maintain a list of employees eligible for a USDA LincPass required for performance of the work.

(d) The responsibility of maintaining a sufficient workforce remains with the Contractor. Contractor employees may be barred by the mailto:chansen01@fs.fed.us mailto:thomas.wenner@usda.gov

Government from performance of work should they be found ineligible or have lost eligibility for a USDA LincPass. Failure to maintain a sufficient workforce of employees eligible for a USDA LincPass may be grounds for termination of the contract.

(e) The Contractor shall insert this clause in all subcontracts when the subcontractor is required to have routine unaccompanied physical access to a Federally-controlled facility and/or routine unaccompanied access to a Federally-controlled information system.

(f) The PIV Sponsor for this contract is a designated program point of contact, which in most cases is the COR/COTR, unless otherwise specified in this contract. The PIV Sponsor will be available to receive Contractor identity information from 8:00 a.m. to 4:30 p.m. on Monday, Wednesday and Thursday at the Utah Acquisition Support Center, 2222 West 2300 South, Salt Lake City, UT 84119. The Government will notify the Contractor if there is a change in the PIV Sponsor, the office address, or the office hours for registration; however, it is the Contractor’s responsibility to meet all aspects of paragraphs (c), (d),and (e).

Statement: CONTRACTOR RESPONSIBILITIES – The Contractor shall not employ persons for work on the contract if such employee is considered by the Contracting Officer’s Representative (COR) to be a potential threat to the health, safety, security, general well-being, or operation mission of the Agency.

a. The Contractor shall supply some type of identification that must be worn at all times while on the premises by Contractor and his/her employees. (FAR 52.204-9 -- Personal Identity Verification of Contractor Personnel)

Statement: IDENTIFICATION OF CONTRACTOR EMPLOYEES:

All contract personnel are required to identify themselves as contractors. In any situations where their contractor status is not obvious to third parties, they must make their status known to avoid creating an impression that they are Government employees.

Statement: SECURITY

The Contracting Officer’s Representative (COR) for this contract will assist with the Contractor’s entry into secure areas and inform the Contractor of security procedures. The Contractor shall comply with all security procedures.

All doors shall remain locked while Contractor performs the work and the Contractor shall ensure that all exterior doors are shut and locked prior to departure. The Contractor shall also ensure that all unnecessary lights and faucets are turned off, and all windows are closed.

All secured interior office doors shall remain locked while Contractor performs the work and the contractor shall ensure that those doors are locked and secured prior to departure. Offices shall only remain open while Contractor is present.

The Contractor shall not adjust any mechanical equipment controls, shall report any fires and hazardous conditions, shall turn in lost and found articles, and shall notify the Contracting Officer’s Representative (COR) when an unauthorized or suspicious person(s) is seen on the premises.

The Forest Service reserves the right to perform security checks on Contractor employees.
