Justification and Approval – Simplified Acquisition under $150,000

FACTS SUPPORTING A REQUEST TO ENTER INTO AN ACQUISITION USING OTHER THAN FULL

AND OPEN COMPETITION – SIMPLIFIED ACQUISITION (UNDER $150,000)

REQ no. Requestor Johnny Tam Office Code Phone no. 301-435-7821

Introduction: Pursuant to Federal Acquisition Regulation 13.106-3(b)(3)(i), the following data is furnished to the Contracting Officer to support the requisitioning office’s request that the items/services identified on the above-mentioned Requisition be obtained using other than full and open competition. The requisitioning office understands that a contract may not be awarded on a sole source/brand name only basis unless the Contracting Officer approves Other than Full and Open Competition.

1. Identification of the Agency: HHS/NIH/NEI

2. Nature and or/Description of Action Being Approved. sole source

3. Description of the supplies and services required to meet the Agency’s needs. The

DM97-15 BOL142 is a high stroke deformable mirror. A Specific Request (Resale to ALPAO the DM97-15 S/N BOL142 with its Drive electronics S/N AUL143) as a trade-in to procure TWO new DM97-15 with High stability option and Large Stroke is needed in order to upgrade one existing adaptive optics instrument and to deploy one additional, next generation adaptive optics instrument being built at the National Eye Institute Eye Clinic. The combination of high stability and large stroke are needed in order to replicate experimental procedures published in [Sulai YN, Dubra A. Non-common path aberration correction in an adaptive optics scanning ophthalmoscope. Biomedical optics express.

2014 Sep 1;5(9):3059-73.].

4. Proposed Contractor’s unique qualifications.

a. Replacement parts: This is a trade-in agreement for an existing device (DM97-15

S/N BOL142 with drive electronics S/N AUL143) that can only be performed by Alpao. The custom modified deformable mirrors (DM97-15 with High stability and Large stroke) is needed in order to replicate experimental procedures published in [Sulai YN, Dubra A. Non-common path aberration correction in an adaptive optics scanning ophthalmoscope. Biomedical optics express. 2014 Sep 1;5(9):3059-73.]. Extensive testing has already been performed using the DM97- 15 S/N BOL142 device under NIH human subjects protocol 15-EI-0020 on an existing adaptive optics instrument and it is imperative that the replacement part be compatible with the instrument deployed under contract HHSN263201400011C. Changing variables by selecting an alternate manufacturer could result in inconsistent data between longitudinal study visits.

Reference to the use of this item can be found under Annual Report ZIA EY000544-05. We must continue to use the Alpao DM97-15 model in order to avoid the introduction of new variables into experimental results and to avoid long delays from retesting of products with different characteristics. There is no other manufacturer that can trade in this device and guarantee an upgrade provide replacement parts for two identical deformable mirrors required to meet the needs of the Clinical and Translational Imaging Unit. For the reasons detailed above, there is only one responsible source and no other supplies or services will satisfy (FAR 6.302-1).

5. Additional Supporting Facts.

a. Manufacturer is going to receive an existing item that they manufactured and provide two upgraded versions of the item. Only the original manufacturer can carry out this task.

I hereby certify that the supporting data above forms the basis for this justification, is complete and accurate to the best of my knowledge and belief.

Certification by Requirements\Technical Personnel:

Johnny Tam

I concur and approve this justification for other than full and open competition.
