About this file

This justification document authorizes the use of other than full and open competition for the procurement of maintenance services for Motorola radio infrastructure and handheld/mobile radios. The Defense Logistics Agency requires maintenance and support services for existing Motorola equipment at multiple locations under the current contract. The services include minor software upgrades, hardware replacements, radio repairs, and installation of mobile radios. A new contract will be awarded for a one-year base period and two one-year options through an RFP posted on SAM.gov. Pricing will be firm fixed price. Only Motorola is qualified to perform the required services due to the proprietary nature of the equipment and software, and to ensure compatibility with the existing Motorola system. The estimated value is redacted. The justification cites FAR authority and confirms Motorola as the only responsible source able to meet the agency's needs.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY.

Requesting Agency:

Defense Logistics Agency J64 Network Telecommunications Services 8000 Jefferson Davis Highway Richmond, VA 23297-5002

Contracting Activity:

DLA Contracting Service Office - Philadelphia

700 Robbins Avenue Philadelphia, PA 19111

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

This justification authorizes the use of other than full and open competition for the procurement of brand name specific Motorola Radio Infrastructure handheld/mobile radio hardware maintenance. The solicitation will be issued via Open Market procedures as a Combined Synopsis/Solicitation-Request for Proposal (RFP) posted to the Contract Opportunities on the Beta.SAM.gov website, which has replaced the Federal Business Opportunities (FBO) website.

The award of a firm-fixed price contract is contemplated.

3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE).

DLA has a requirement to renew maintenance and support services on existing Motorola Radio Infrastructure and hand-held/mobile radios currently maintained under contract SP4701-17-C- 0071.

DLA’s requirement for maintenance support will include minor software upgrades, known as “patch releases”, which may include commercial Operating Software (“OS”) and application

Source Selection Information – See FAR 2.102 & 3.104 Page 2 of 6 Pages software patches and service pack updates as they become available. This will also include hardware version updates and/or replacements necessary to upgrade the system to an eligible system release with an equivalent level of functionality. Any system changes or updates must maintain the existing features and functionality of the current system release.

The requirement also includes implementation services necessary to upgrade the DLA Trunked Radio System to an eligible system release with an equivalent level of functionality. As major system releases become available, the contractor will provide software design and technical resources necessary to complete system release upgrades up to a maximum of one system release upgrade per 24-month period. The contractor will perform radio repair on handheld radios and install/de-install/replace mobile radios in DLA vehicles.

The requirement will be for one (1) 12-month base year and two (2) 12-month option periods.

The base Period of Performance (PoP) will be from September 3, 2020 through September 2, 2021. The base period will be fully funded using FY20 funds. The estimated dollar value is:

The Motorola handheld/radio hardware maintenance and support services requirements are listed in the attached document: ATTACHMENT 1 – STATEMENT OF WORK (SOW).

4. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER

THAN FULL AND OPEN COMPETITION:

The statutory authority permitting other than full and open competition is Title 10, U.S.C 2304 (c),(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy the agency requirement.” Only authorized resellers of brand name, Motorola, are able to provide customized Motorola Radio Infrastructure handheld/mobile radio hardware maintenance to DLA.

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITIONS REQUIRES USE OF

THE AUTHORITY CITED:

In accordance with FAR 6.302-1, the Motorola brand name is essential to the Government’s requirement because the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy the agency’s requirements. A brand name product, whether available on one or more contracts, is an item particular to one manufacturer and may be procured by brand name specification if essential to the Government’s requirements. The required Motorola brand name services are necessary to maintain critical Motorola hardware and software at multiple DLA locations. The Motorola brand name is essential to the Government’s requirements, thereby precluding consideration of products manufactured by another company.

Source Selection Information – See FAR 2.102 & 3.104 Page 3 of 6 Pages

This requirement is to maintain and upgrade DLA’s existing Motorola Trunked Radio System which must be compatible with the current Motorola Trunked System on-site trunking equipment at DLA Columbus, DLA Mechanicsburg, DLA New Cumberland, DLA Richmond, and DLA Tracy. This will include firmware and software upgrades and maintenance for the Motorola ASTRO equipment, hand-held radios and mobile radios.

Motorola Solutions, Inc. is the only source that can provide the required System Upgrade and Maintenance because of the proprietary equipment being supported. Motorola, as the manufacturer of the radio equipment, has proprietary software tools and processes to allow for the expedient repair and replacement of problem components within the system. Allowing DLA direct access to Motorola radio system development, design and manufacturing teams will help to resolve issues on the system. Upgrades are done with factory engineering team involvement to ensure a smooth and pre-tested plan that minimizes disruption to operations. Motorola on-site system technicians are available across the country as well as directly on-site full time in Richmond, VA and Columbus, Ohio. These Motorola technicians ensure 24x7 support for all DLA Trunked Radio System sites.

Allowing a non-Motorola company/vendor, or unauthorized reseller, to conduct maintenance, warranty work or system upgrades to DLA’s existing Motorola infrastructure would void existing warranties. Software ‘patch releases’ and major ‘system upgrades’ must be 100% compatible with the current DLA Radio infrastructure. Motorola tests and stages every software release prior to it being deployed to field sites like DLA’s. Non-Motorola companies are unable to provide these services. Further, for the maintenance on the existing Motorola infrastructure components at DLA Columbus, DLA Mechanicsburg, DLA New Cumberland, DLA Richmond, and DLA Tracy and Motorola handheld and mobile radios, non-Motorola radio vendors are not qualified to perform the services outlined in the statement of work. No other vendors are certified or qualified to work on Motorola products. Additional DLA requirements are: access to Motorola Product Engineering Staff and Support Personnel, which allows DLA’s Radio System Program Manager and System Site Managers access to a fully functional Motorola Test System for trouble shooting efforts, and access to the latest Motorola Software and Software tools. The ability to trouble shoot on a live system identical to DLA’s system is unique to Motorola and allows for efficient problem resolution without impeding on DLA’s system that supports critical first responder safety. ‘Motorola software’ includes programming software for radios and equipment which is used by each DLA System and Site Manager.

Failure to continue Motorola Maintenance on DLA’s Radio System will have a severe impact on DLA Emergency Services throughout CONUS, and will render the system inoperable. If the radio system goes down or is not functioning properly, DLA Fireman and Policeman would have no way to communicate during an emergency situation such as an active shooter event, fire, vehicle accident, personal injury or serious health event. The radio system is the primary means of communications for all DLA Fire and Police emergency services.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:

Motorola is the only known firm that provides Motorola Radio Infrastructure and hand-held

Source Selection Information – See FAR 2.102 & 3.104 Page 4 of 6 Pages radio maintenance and support services. The requirement will be synopsized through Beta.SAM.Gov. All authorized dealers of Motorola will be given an opportunity to submit an offer. An RFP will be solicited on an Unrestricted basis on Beta.SAM.gov.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various prices analysis techniques including, but not limited to:1) comparison of proposed prices received in response to the solicitation (reference FAR 15.404-1(b)(2)(i); 2) comparison with competitive published price lists (reference FAR 15.404-1(b)(2)(iv); and 3) comparison of proposed prices with prices obtained through market research of the same or similar items (reference FAR 15.404- 1(b)(2)(vi)), in order to obtain a fair and reasonable price.

8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED:

Market research actions were conducted amongst the Original Equipment Manufacturer (OEM), Motorola, and authorized resellers of the required support. The findings from this market research subsequently confirmed that several businesses can provide this type of support.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION:

Only Motorola brand name maintenance meets the Government’s needs. Use of third-party maintenance would result in voiding warranties for existing specific devices. DLA would incur higher costs for ad hoc maintenance if not under a maintenance contract.

10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN

INTEREST IN THE ACQUISITION:

Source Selection Information – See FAR 2.102 & 3.104 Page 5 of 6 Pages

11. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE

OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT

ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED:

At this time, the required Motorola handheld/radio maintenance and support services is the only product that will support DLA’s requirements and meet the Government’s needs. However, DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and the Government. As a continuing effort, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure full and open competition to the maximum extent practicable.
