About this file

This is a Decision to Restrict Competition under the Simplified Acquisition Threshold issued by the United States Department of Agriculture (USDA) for requisition number 1165254. The requesting activity is PWA Sustainable Agricultural Water, and the contracting activity is USDA ARS. The acquisition seeks original equipment manufacturer (OEM) repair services for a Government-owned RIEGL LiDAR camera system that is currently malfunctioning and unable to perform reliable data collection. The required service includes OEM diagnostics to identify root causes, repair or replacement of failed components using OEM parts or OEM-approved equivalents, and calibration and firmware/software actions to restore the unit to full operational condition consistent with manufacturer specifications.

The competition restriction is justified based on the proprietary nature of the RIEGL LiDAR camera system, which requires access to OEM-only diagnostic software, calibration routines, firmware tools, and specialized parts unavailable through third-party repair providers. The Government determined that non-OEM repair services could result in improper calibration, non-compatible component substitutions, degraded measurement accuracy, and voided warranties or eliminated OEM support. The suggested source is RIEGL USA, INC, located at 14707 West Colonial Drive, Winter Garden, FL 34787. Market research confirmed that RIEGL does not have any certified parties outside their company authorized to provide warranty service and repair on their equipment. The document includes certification sections for both Technical/Requirements Personnel and the Contracting Officer, though signatures and dates have been redacted.

United States Department of Agriculture Decision to Restrict Competition under the Simplified Acquisition Threshold

Identification Number:

Rev. 10/29/25

In accordance with the Revolutionary Federal Acquisition Regulation (FAR) Overhaul (RFO) FAR

12.102 (a), the following documents the decision to restrict competition for this acquisition.

(1) Mission Area and Contracting Activity.

Requisition Number: 1165254

Requesting Activity Agency:

PWA Sustainable Agricultural Water

Contracting Activity:

USDA ARS

(2) Brief Description of Supplies or Services The purchase of original equipment manufacturer (OEM) repair services for a Government-owned LiDAR camera system that is currently malfunctioning and cannot be used for reliable data collection.

The required service includes (at minimum) OEM diagnostics to identify the root cause of the issue(s), repair or replacement of failed components using OEM parts or OEM-approved equivalents, and any necessary calibration and firmware/software actions to restore the unit to full operational condition consistent with the manufacturer’s specifications.

(3) Suggested Source

RIEGL USA, INC

14707 West Colonial Drive Winter Garden, FL 34787

(4) Justification for Restricting Competition and the Basis for that Decision.

A. Explain the unique qualifications/characteristics of the proposed contractor or product and why no other contractor or product/service can meet the Government's need.

This repair must be procured from the RIEGL because the LiDAR camera is proprietary, and restoration to manufacturer performance specifications requires access to OEM-only diagnostic software, calibration routines, firmware tools, and specialized parts that are not available through third-party repair shops. Use of a non-OEM repair provider would risk improper calibration and/or non-compatible component substitutions that could degrade measurement accuracy and reliability, resulting in point cloud outputs that are not suitable for ARS research applications and could void existing warranties or eliminate OEM support for future service.

Accordingly, to ensure the system is returned to service in a manufacturer-certified condition and maintains traceable performance to OEM specifications, the repair must be performed by

RIEGL.

B. Describe market research conducted and the results or the reason why no market research was conducted.

Contact with RIEGL indicates that they do not have any certified parties, outside of their company, that can provide warranty service and repair on their equipment.
