About this file

This is a FAR Part 13 Single Source Justification document from the U.S. Marshals Service (USMS) Asset Forfeiture Division for awarding a sole-source contract to RBEX Inc. for vehicle services in New York and New Jersey. The justification covers a 6-month contract from February 23, 2025 to August 22, 2025, with an estimated value of $452,287.30.

The required services include towing, storage, maintenance, and disposal of seized/forfeited vehicles including production-sized cars, trucks, vans, motorcycles, specialty vehicles, and trailer-able boats. RBEX Inc. is justified as the sole source provider due to their existing infrastructure, proven performance as the incumbent, and ability to provide immediate services without interruption. The justification cites personnel attrition and competing requirements as reasons for not conducting a follow-on competitive acquisition, with plans to release a new competitive award by 3rd quarter 2025. Price reasonableness will be determined through market research, comparison with previous purchases, and comparison to an Independent Government Cost Estimate.

Background

As required by FAR 13.106-3(b)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold for commercial items/services.

Description of Supply or Service

The United States Marshals Service (USMS) has a requirement for towing, storage, maintenance, and disposal of seized/forfeited vehicles in the District of New York and District of New Jersey for a six (6) month period beginning on February 23, 2025 and ending August 22, 2025. The vehicles will include production-sized cars, trucks, vans, motorcycles, etc.

The U.S. Marshal Service (USMS) has a requirement for towing/transporting, appraisal, storage, maintenance, and disposal services for motor vehicles, commercial and passenger.

Additionally, these same services may be required for specialty vehicles such as but not limited to motorcycles, all-terrain vehicles, golf carts, jet skis, trailer able boats. The current

FAR Part 13 – Soliciting from a Single Source for Towing, Storage, Maintenance and Disposal of Seized and/or

Forfeited Vehicles – New York & New Jersey mobilization, other exclusive qualifications) purchase order for the execution of the above stated services is ending on 2/22/2025, and due to competing requirements and recent personnel attrition, the Procurement Unit has been unable to conduct a follow-on acquisition. The current contractor RBEX Inc. successfully provides the ongoing services and has an existing infrastructure and organizational plan established to process this asset type. The incumbent has the capability to be at relocation sites with law enforcement agencies at time of seizure or post investigative custody to move the required motor vehicle to its existing storage facility. The incumbent has the industry knowledge to provide these services to the USMS, along with superior service. In addition, the vendor can provide all services and supplies immediately as it has an existing footprint and can mobilize immediately, as needed. This ability is invaluable from a law enforcement, governmental, and logistical perspective. This ability allows the USMS to act nimbly in any given situation and provide seamless services to the United States Government.

As previously stated, the incumbent is the only source that can provide the required services on an ongoing basis without unacceptable delay and interruption, which would otherwise result in significant adverse impact to the agency’s mission.

Therefore, the Government minimum needs can only be satisfied by RBEX Inc. until the re-competition effort gets underway for the new award to be released by 3rd QTR 2025.
