Defense Logistics Agency
About this file
This justification and approval document authorizes a sole-source contract award to Electronics for Imaging, Inc. for Market StoreFront software license maintenance and support services. The Defense Logistics Agency requires this proprietary software and support to maintain operations of its Document Automation Management and Document Services Online applications, which process print orders for over 142 military print sites. As the sole provider of maintenance and support for its specialized Market StoreFront software installed at DLA, Electronics for Imaging is the only company capable of meeting the agency's needs to ensure continued functionality of these critical systems. Pricing will be determined fair and reasonable through comparison to similar products and services as well as an independent cost estimate. The agency considers this a short-term solution and will continue exploring alternatives to promote further competition once substitute technologies emerge.

JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN
COMPETITION
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY:
Requiring Activity:
Defense Logistics Agency (DLA) J62KA Enterprise Capabilities Building 721 McFarland Street Jacksonville, FL 32212-0003
Contracting Activity:
DLA Contracting Services Office, Philadelphia (DCSO-P) 700 Robbins Avenue Philadelphia, PA 19111
2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:
This justification authorizes the use of other than full and open competition for the sole source procurement of brand name specific Market StoreFront Software license maintenance and support services. The solicitation will be issued as “Unrestricted” via Open Market procedures as a Combined Synopsis/Solicitation Request for Proposal (RFP) posted to the Contract Opportunities (www.beta.sam.gov) system. The award of a firm-fixed price (FFP) contract is contemplated.
Pursuant to Federal Acquisition Regulation (FAR) 6.302-1(c), this Justification and Approval (J&A) authorizes and approves the use of other than full and open competition for the procurement of software maintenance and support services that are peculiar to one manufacturer, Electronics for Imaging, Inc. (EFI). The Government has a requirement to procure brand name specific EFI Market Storefront (MSF) software maintenance and approximately 185 hours of support services per each 12-month period of performance (PoP).
The required software maintenance agreement and support services are necessary to support DLA’s existing EFI MSF software that is currently used for the DLA J62KA Enterprise Data Solutions, Document Automation Management, Document Services Online (DSO) application.
The PoP for this requirement will consist of one (1) 12-month base period, from
For Official Use Only (FOUO) maintenance and support services are essential to ensuring DLA’s DSO application continues to operate as a web tool for order fulfillment, outsourcing interface, and billing for all print service offerings. MSF is EFI’s web-to-print software solution. For DSO, MSF is the software that provides all order submission and print queue management functionalities. Without the MSF license renewal, there would be no virtual order fulfillment capability available to support the DLA customer. Furthermore, all the military departments – Army, Air Force, Navy, and Marines – use the DSO tool for print order submission. Without the DSO tool, DLA Document Services would be unable to fulfill orders in over 142 locations, where a brick and mortal print facility is not present. These virtual print shops rely solely on the DSO web-to-print tool to complete order fulfillment. Consequently, failure to obtain EFI MSF software license maintenance and support services would place DLA Document Services at a significant risk of failure.
The DLA site requires support for over 142 print sites, 2 interfaces, and 5 unique integration requirements, which makes the support, configuration, and patching of the DLA installation highly complex. Electronics for Imaging, Inc. is the only provider that can support the size and complexity of the required software license maintenance and support services for DLA’s EFI MSF software; therefore, it is the only source capable of meeting current requirements.
Resellers of the EFI MSF software do not have the experience or skills to support the DLA MSF installation. No other company’s software license maintenance and support services can meet, or be modified to meet, the Agency’s requirement.
6. DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS
PRACTICABLE, INCLUDING WHETHER A NOTICE WILL BE
PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH
EXCEPTION UNDER 5.202 APPLIES:
Based upon market research, it has been determined that only brand-name EFI MSF software license maintenance and support services can fully meet the Government’s requirement. Market research included review of procurement history, the responses to the Request for Information (RFI) 20-40006 on Open Market, the information provided in the Global Web-to-Print Market Research, and the responses to the RFI 20-40006 announced on the J6 Technology Enterprise Services (JETS) contract. It was determined that there are no other products that meet the Government’s needs. This requirement will be posted to the Contract Opportunities webpage on beta.sam.gov.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE:
As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable. Prices will be determined fair and reasonable prior to award using the price analysis techniques described under FAR 15.404-1. The Government will use various pricing techniques including, but not limited to: (1) comparison of proposed pricing to that of similar software products and services, and (2) comparison of proposed pricing to the Independent Government Cost Estimate. Pricing comparison information can also be found in the market research documentation. The Contracting Officer will evaluate and determine that the apparent awardee’s proposed price is fair and reasonable prior to award.
For Official Use Only (FOUO) provide the needed support required during upgrades and patching – tasks that are included in the licensing agreement.
11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE
ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES
REQUIRED:
EFI MSF software is so embedded within DLA’s DSO application that eliminating this brand name requirement to remove a barrier to competition would require an overhaul of the Electronics for Imaging Market StoreFront software currently in use at DLA. In order to make a fair assessment of replacing the core commercial software EFI MSF, a RFI 20-400005 was released to determine if other web-to-print software could meet the Government’s requirements and therefore replace EFI MSF. The market research and the lack of responses from the RFI demonstrated that the web-to-print market is shrinking in number of vendors offering solutions and support that meet the Government’s requirements.
In accordance with DLA policy and DLA’s IT Solutions document, whenever substantial improvement over presently identified solutions is demonstrated, the existing IT Solutions document will be updated to ensure DLA continues to use the best products and services for its mission requirements.
DLA continues to exercise competition as often as possible and is required to conduct ongoing reviews of IT solutions in order to keep abreast of new technology within the Government and private sectors. At this time, EFI MSF software license maintenance and support services are the best products and services to meet DLA mission requirements and are the only products and services that will satisfy the Government’s needs. DLA uses a variety of vendors, manufacturers, and contracts/orders to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition to the maximum extent practicable.
