About this file

This document is a Justification for Other Than Full and Open Competition (J&A) for local guard security services at the U.S. Embassy in Brussels. The Department of State is seeking to extend the current contract (19AQMM20C0018) with the incumbent contractor for a 12-month period from September 1, 2025 through August 31, 2026, with an estimated value of $12,557,231.67. The extension is necessitated by delays in the reprocurement process due to personnel shortages and lack of engagement from the Post in gathering requirement information.

The contract will provide overseas guard services to protection United States personnel, facilities, and equipment from damage, loss, violent attacks, and theft. The incumbent contractor is the only firm currently able to immediately provide a fully vetted and trained security guard force with all necessary operating licenses and permits. The government is conducting a full and open competition with an estimated contract award date of December 2025, and has posted a sources sought notice and full solicitation on SAM.gov to promote competition for the subsequent acquisition.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SECTION 1: IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

Department of State Contracting Activity

Office of Acquisitions Management

Requiring Activity A/GA/AMD/DM/SEC/OGS

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

The current Contract expired on 28, February 2025. The Option to Extend Services modification was exercised on 1, March 2025, to extend services by six (6) months from 1 March 2025, through 31 August 2025, in accordance with FAR 52.217-8. The government is conducting a full and open competition with an estimated contract award date of December 2025. However, additional time for Overseas guard services is being requested because there were delays in starting the reprocurement process as DS/FPD/OPO was experiencing significant personnel shortages among their desk officers and Acquisition Management Analysts. OPO also experienced delays from lack of active engagement from Post in garnering the necessary requirement information. As such, additional time is being requested for local guard services due to the solicitation process starting late. We are requesting an extension to the current contract with a period of performance of 1 September 2025 up to/through 31 August 2026. The requested periods of performance for the extension are identified in Section 3.

The action to be approved is for the contract extension of 19AQMM20C0018 to the incumbent contactor, . Failure to permit the execution of this extension could result in a disruption of current services and cause serious injury to the U.S. Government.

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION

This acquisition is conducted under the authority of 41 USC 3304, as implemented by FAR 6.3 and substantiated by the following:

FAR 6.302-2 Unusual and compelling urgency.

is the incumbent contractor currently providing services and possesses a valid security license.

They are the only firm that can provide a complete fully vetted and equipped guard with all necessary operating licenses and permits for the host country. They have current job knowledge and functioning operations in place to ensure continuous local guard services. To consider any other vendor would take considerable transition time to confirm licenses, transfer guard personnel, establish equipment, vet all required personnel, and stand up a fully functional guard force consistent with federal government requirements.

SECTION 6. DESCRIPTION OF EFFORTS TO ENSURE THAT OFFERS WERE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR

WILL BE PUBLICIZED AS REQUIRED BY FAR SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION

UNDER FAR 5.202 APPLIES

A Sources Sought/Pre-solicitation notice was posted on SAM.gov, on 17 September 2024. This garnered interest from multiple Small Businesses (details in Section 10). The government also just released the full and open solicitation on SAM.gov on 21 February 2025.

However, these companies cannot stand up a fully trained and vetted guard force for this one-year extension within the time prior to Dash-8 expiring on 31 August 2025.

SECTION 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION

The current contract with competed full and open competition when solicitated on June 17, 2019. U.S. Mission Brussels, Belgium cannot operate with any break in overseas guard services because matters of security for the U.S. mission are of the utmost importance. A disruption in Overseas Guard Services could cripple Mission operations, jeopardizing the Mission, and possibly lives. In addition, trying to transition to another source provider would have a significant cost impact to the current IGCE to be able to obtain licenses, train guards and transition within the short time frame.

SECTION 10. LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST

IN THE ACQUISITION

As stated in Section 6, the pre-solicitation synopsis was posted on 17 September 2024 which received interest from requesting access to the restricted documents once the competitive solicitation is posted. The list is as follows:

However, due to the urgency of this requirement, the Department of State limited the number of sources considered to firms with proven track records of providing overseas guard services in Brussels, the financial resources to rapidly deploy services, and the means to quickly take over management of the overseas guard force in Brussels. is the only company who currently has a fully vetted and trained security guard force who can immediately provide the required services.
