About this file

This document is a Brand Name Justification and Approval for the purchase of InBody 270 & 970 Body Analyzers. The Utah Army National Guard requires these analyzers to conduct body composition testing for service members. The InBody Analyzers were determined to be a brand name item as Biospace, Inc. holds the intellectual property rights and is the sole source provider and distributor in North America. The analyzers offer quick, non-invasive segmental lean analysis, muscle-fat analysis, and body fat percentage measurements in under two minutes, with compact size and portability. While comparable to gold standards like DEXA and underwater weighing in accuracy and reproducibility, the InBody Analyzers provide the measurements at far lower expense and without exposure to radiation. The price will be determined fair and reasonable through competitive quotes from authorized small business retailers. The related solicitation is for the InBody 270 & 970 Body Analyzers branded product or equal, to be awarded by the Utah Army National Guard.

BRAND NAME JUSTIFICATION AND APPROVAL

Purchase Request # / Requisition # / 11987265 / W5654Q31590102

Organization / Line Office / Contracting Activity: Utah Army National Guard / 19th SF / USPFO-UT P&C

Description of Action being approved: New contract, Firm-Fixed Price

Description of Product, Supplies or Services required to meet the Agency’s needs: InBody 270 & 970 Analyzers

Statutory Authority permitting other than full and open competition: This acquisition is being conducted under the authority of Federal Acquisition Regulation (FAR) 6.302-1(c)

Identification of the Justification Rationale:

1. The InBody Analyzers are unique analyzers in the marketplace that have the quick, non-invasive, unique analyzing aspects of Segmental Lean Analysis, Muscle-Fat Analysis, and Percent Body Fat all within a 2 minute body composition test. The fit, form, function, ease of use, and portability give these analyzers a competitive edge over other competitors products.

2. Biospace, Inc., together with its parent company InBody Co., Ltd., hold the intellectual property and ownership rights to InBody professional devices and accessories, such as InBody Tissues and InBody Result Sheets, and Biospace, Inc. is the sole source provider of such items and the sole distributor of InBody products in North America.

3. The analyzers are compact, taking up as much room as an average standing person would, making it easy to fit into testing areas both large and small.

4. While this unit is technologically advanced and provides measurements of an accuracy and reproducibility comparable to gold standards in body composition analysis, such as DEXA and Underwater Weighing, it is far less expensive. It’s also a non-invasive measurement method, unlike DEXA, which exposes users to X-rays, and Underwater Weighing, which requires users to change into swimwear and be submerged in a Hydrostatic Weighing tank. The package price for the InBody Analyzers cost significantly less than the DEXA scanner costs.

Fair and Reasonable Price Determination: Award issued under this individual limited sources justification represents a fair and reasonable price as the agreed to pricing will be based upon competitive quotes received from authorized retailers of the brand in a competitive environment. Price analysis will be performed on all quotes received. Therefore, the price paid will represent the best value and result in the lowest overall cost to meet the needs of the Utah National Guard. Price will be determined fair and reasonable based on adequate competition among multiple small business vendors’ pricing.

Actions to Increase Competition: This Brand-Name requirement will be competed among small business vendors first in the marketplace who can supply these brand name items. If no small businesses can provide these analyzers, then will compete as Full and Open Competition.

Market Research conducted: Market research conducted on FPDS.gov resulted in identifying multiple small businesses that could possibly supply this brand name item. Reviewed publicly available information in the marketplace and on various websites. No prior year contracts were awarded from our agency but other government agencies had previous awards for InBody Analyzers.
