FAR PART 8.405-6
Acquisition Plan Action ID: 36C263-22-AP-3252
(1) Contracting Activity: Department of Veterans Affairs, Network 23 Contracting Office, 1303 5th St. Suite 300, Coralville, IA 52241.
Organizational Activity: St. Cloud VA Health Care System, 4801 Veterans Drive, St. Cloud, MN 56303
(2) Description of Action: This acquisition is conducted under the authority of the Multiple- Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501).
Order against FSS Contract Number V797D-60613
Name of Proposed Contractor: Steris Corporation Street Address: 5960 Heisley Rd.
City, State, Zip: Mentor, OH 44060-1834 Phone: 701-371-1780
(3) Description of Supplies or Services:
The estimated value of the proposed action is $
The equipment will be able to perform Cleaning, Disinfection, and Sterilization of all reusable medical devices. This equipment provides effective and efficient sterilization, safeguarding the health and safety of patients.
The equipment fits into one of three categories:
1) Cleaning - washer/disinfectors, cart washers, chemical scope soap dispensers
2) Disinfection - scope reprocessors
3) Sterilization - steam sterilizers, gas plasma sterilizers
The anticipated award date is 9/21/2022. The anticipated period of performance is 9/21/2022
– 9/20/2023.
(4) Identify the Authority and Supporting Rationale:
FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
The St. Cloud VA Medical Center is constructing a new sterilization processing space. Details of the construction such as where the pipes, drains, lights, switches, electrical wires, doors, walls, and more, are located, were all planned with the Steris brand of equipment in mind. Changing the brand at this point would cause changes in design and changes in construction and would significantly increase cost and delay the project.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:
The requirement is available via the Steris Corporation contract, V797D-60613, which has been determined to be fair and reasonable. In accordance with FAR 8.405-4, the Government will request a price reduction.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Research to find more sources on schedule were unsuccessful. VA Strategic Source Initiative Contracts were surveyed, and other Steris sources were not located. An RFI was posted on GSA from 9/4/2022 – 9/8/2022, but no company other than Steris responded. Market research revealed items are available on GSA/FSS by a sole vendor, Steris Corporation, the OEM, a large business.
The Vendor Information Pages Database was searched using NAICS 339113 which resulted in 549 SD/VOSBs. However, due to reasons stated above, other businesses cannot provide the necessary equipment.
(7) Any Other Facts Supporting the Justification:
According to the terms and conditions of contract V797D-60613, all items are produced in the United States except sterilizers and washers which are produced in Mexico and Canada, respectively. Both Mexico and Canada are included in the World Trade Organization Government Procurement Agreement (WTO GPA), that is, TAA compliant.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
For reasons stated above, this requirement could not be considered for unrestricted competition.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
