A developmental disability means a disorder or syndrome that is attributable to intellectual disability, cerebral palsy, autism, spina bifida, Down syndrome, Phelan-McDermid syndrome, or Prader-Willi syndrome; that manifests before the age of 18; and that constitutes a substantial handicap that can reasonably be expected to continue indefinitely.

H. Mandatory Responsiveness Requirements: Terms, conditions or requirements that must be met by the Respondent to be responsive to this solicitation. These responsiveness requirements are mandatory. The use of shall, must or will (except to indicate simple futurity) in this solicitation indicates a requirement or condition from which a material deviation may not be waived by the Agency. A deviation is material if, in the Agency’s sole discretion, the deficient response is not in substantial accord with this solicitation’s requirements, provides an advantage to one Respondents over other Respondents, has a potentially significant effect on the quantity or quality of items Bid, or on the cost to the Agency or otherwise adversely impact the Agency’s interest. THE AGENCY HAS CHOSEN TO USE THE INVITATION TO BID (ITB) METHOD OF PROCUREMENT BECAUSE THE AGENCY IS ABLE TO DEFINE ITS REQUIREMENTS, SPECIFICATIONS, AND PERFORMANCE EXPECTATIONS WITH SUFFICIENT DETAIL TO PERMIT THE SUBMISSION OF RESPONSIVE BIDS. ALTHOUGH THIS ITB MAY USE MANDATORY TERMS SUCH AS "SHALL," "WILL," AND "MUST," AND MAY IDENTIFY CERTAIN PROVISIONS AS REQUIREMENTS, THE AGENCY RESERVES THE RIGHT TO WAIVE MINOR IRREGULARITIES OR MINOR DEVIATIONS IN ACCORDANCE WITH APPLICABLE LAW, RULE, AND THE TERMS AND CONDITIONS OF THIS ITB WHEN SUCH WAIVER IS DETERMINED TO BE IN THE BEST INTEREST OF THE STATE OF FLORIDA AND DOES NOT PROVIDE AN UNFAIR COMPETITIVE ADVANTAGE TO ANY BIDDER. Pursuant to F.S., Section 120.57(3) (b):

Any person who is adversely affected by the agency decision or intended decision shall file with the agency a notice of protest in writing within 72 hours after the posting of the notice of decision or intended decision. With respect to a protest of the terms, conditions, and specifications contained in a solicitation, including any provisions governing the methods for ranking Bids, Proposals, or Replies, awarding contracts, reserving rights of further negotiation, or modifying or amending any contract, the notice of protest shall be filed in writing within 72 hours after the posting of the solicitation. The formal written protest shall be filed within 10 days after the date the notice of protest is filed. Failure to file a notice of protest or failure to file a formal written protest shall constitute a waiver of proceedings under this chapter. The formal written protest shall state with particularity the facts and law upon which the protest is based. Saturdays, Sundays, and State holidays shall be excluded in the computation of the 72-hour time periods provided by this paragraph.

Section 120.57(3) (a) provides:

The bond shall be conditioned upon the payment of all costs and charges that are adjudged against the protestor in the administrative hearing in which the action is brought and in any subsequent appellate court proceeding.

The Notice of Protest, Formal Written Protest, and Protest Bond shall be filed with the Agency Clerk. A copy shall also be provided to the Agency Point of Contact identified in SECTION 4.3 AGENCY POINT OF CONTACT. The redacted copy shall contain the Agency’s solicitation name and number and the Respondent’s name on the cover and shall be clearly titled “Redacted Copy.” The Respondent shall redact only the specific information for which it claims an exemption from public disclosure.

If the Respondent fails to submit a Redacted Copy with its Response, the Agency may produce the documents, data, and records submitted by the Respondent in response to a public records request. Notwithstanding any markings, redactions, or assertions made by the Respondent, the Agency reserves the right to disclose any materials it determines are public records and not exempt from disclosure under applicable law.

Public records request should be submitted to:

Attn: Agency Clerk

4030 Esplanade Way, Suite 335,

5.8 Poor Performance Notice

The Respondent should provide for both the Respondent and its employees, subcontractors, and the subcontractor employees, copies of any and all documents regarding complaints filed, investigations made, warning letters or inspection reports issued, any notice of breach, notice of default, termination notice, suspension notice, or any disciplinary action initiated or taken under any contract or job performance within the past seven (7) years. For each instance listed, provide a narrative summary of the contract’s purpose and scope of work, the Respondent’s performance, including the concerns of the project owner, and any major adverse findings. In addition, provide the contract or job number, the name of the owner, the term of the contract, the name, address, and telephone number of the owner’s Contract Manager. Please also include any relevant documentation evidencing the performance issues.

The Agency reserves the right to seek further information on this matter from the Respondent or to make inquiries with the project owner. The information obtained from this review may be reflected in the Respondent’s score or used to declare the Respondent not a responsible vendor.

A Respondent may withdraw its response by submitting written notice to the Purchasing Contact identified in this solicitation on or before the Response submission deadline specified in Section 4.4, Timeline.

5.10 Conditions to the Bid

The only recognized changes to the ITB prior to Bid opening will be a written addenda issued by the Agency.

The Respondent recognizes the Agency’s right to ignore the condition and treat the Bid as if no condition exists.

As in the best interest of the State, the right is reserved to reject any and/or all Bids or to waive any minor irregularity or minor technicality in Bids received in accordance with applicable law and the terms and conditions of this ITB.

Conditions which may cause rejection of Bids include, without limitation, evidence of collusion among Respondents, obvious lack of experience or expertise to perform the required work, failure to perform or meet financial obligations on previous contracts, or failure to comply with the material requirements of this ITB.

ITB 2526-040 Tacachale Refuse Removal Page 13 of 36
