About this file
This is an Iran Free Procurement Certification Form issued by the Commonwealth of Pennsylvania pursuant to Procurement Code Sections 3501-3506. The form applies to vendors seeking contracts with Commonwealth entities valued at $1,000,000 or more. Vendors must certify either that they are not on the current list of persons engaged in investment activities in Iran maintained by the Pennsylvania Department of General Services, or demonstrate they have received an exception to the certification requirement. The form provides two options for compliance: Option #1 requires an authorized representative to certify the vendor's eligibility to contract with the Commonwealth, while Option #2 allows vendors with written exemptions from DGS to proceed on a case-by-case basis. Both options require the vendor name, authorized signature, printed name and title of the signing official, and the date executed.
Pennsylvania law establishes significant penalties for false certifications, including civil penalties equal to the greater of $250,000 or twice the contract amount, contract termination, and three-year ineligibility to bid on Commonwealth contracts. This certification requirement is mandatory for all vendors bidding on contracts valued at $1,000,000 or more with any Commonwealth entity. The form was published on January 26, 2017, and reflects Pennsylvania's commitment to preventing investment activities in Iran through its procurement processes.
