About this file
This document is a Sole-Source Determination and Justification for the Oregon Military Department (OMD) to purchase parts, components, and repair services from InVeris Training Solutions for the Automated Record Fire (ARF) training range at the Raymond F Rees Training Center in Umatilla, Oregon. The OMD requires these parts and services to upgrade the existing Stationary Infantry Targets (SIT) system, which is proprietary to InVeris and not compatible with other manufacturers' equipment. InVeris is the sole source provider for the SIT system, parts, and upgrades, and the OMD intends to issue purchase orders to InVeris for these goods and services, with an estimated total contract value of $300,000.
The OMD has determined that utilizing and upgrading the existing InVeris SIT infrastructure at the ARF range results in significant cost savings compared to obtaining competitive bids for an entirely new system. InVeris is the original equipment manufacturer and the sole authorized reseller of the SIT system installed at the ARF range, and no other third-party providers can supply the necessary parts, components, or upgrades.

SOLE-SOURCE DETERMINATION AND JUSTIFICATION
FOR SUPPLIES AND SERVICES
To: Designated Procurement Officer
Oregon Military Department
From: AGI-Support Branch
Agency Analyst/Procurement Specialist: Sam Goff - CPPB
Date: 06-16-2023
Re: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon
Administrative Rule (OAR) 125-247-0275
1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)
2. Estimated Total Value of Contract: $300,000
3. Subject of Contract: This sole source justification applies to the purchase of parts and repair services for automated Stationary Infantry Targets (“SIT”), manufactured and supported by InVeris
Training Solutions (“InVeris”) formerly Meggitt Training Systems, Inc. (“Meggitt”) for the
Automated Record Fire (“ARF”) training range at the Raymond F Rees Training Center
(“RTC”) located in Umatilla Oregon.
4. Background:
The RTC ARF firing range is used to train and test individual soldiers on the skills necessary to identify, engage, and defeat stationary infantry targets for day/night qualification requirements with specific weapons systems. The ARF range utilizes fully automated Stationary Infantry Targets manufactured by and supported by InVeris/Meggitt. The SIT system at the RTC ARF requires replacing in order to keep the range in proper working order.
InVeris maintains proprietary rights to their products and the components are not interchangeable with other manufacturers’ equipment. The operating software, all interfaces and components are proprietary items owned by InVeris. InVeris has no authorized distributors for parts or equipment.
The Oregon Military Department (OMD) intends to issue Purchase Orders to InVeris for parts, components, and repair services necessary to upgrade the RTC ARF range. Purchases will include but not be limited to targets, parts, pieces, components, and upgrades to existing computer systems that operate the SIT to meet current operational standards.
5. Findings: Findings of Fact
A. Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
InVeris's Stationary Infantry Targets (SIT) and parts are the only commercially available products that will successfully integrate with the existing InVeris/Megget SIT equipment already in place on the RTC ARF range. InVeris is the only source for parts, pieces, components, and upgrades and holds all proprietary rights.
InVeris's will not guarantee any components which they have not provided, will not guarantee other equipment or existing equipment will function properly utilizing other manufacturers provided equipment, nor will InVeris be liable for any damages to existing InVeris’s equipment outfitted with other manufacturers’ equipment.
Utilizing and upgrading the existing InVeris SIT infrastructure at the RTC ARF results in a significant savings to the Agency and taxpayers. Obtaining competitive bids would require obtaining bids for an entire new system which is not warranted and, would result in the Agency not being good stewards of taxpayer funds.
B. Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data. Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
NA
C. Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project. Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.
NA
D. Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and
Services are available from only one source may include but are not limited to considerations of:
unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
The goods and services under this Sole Source memo are not available under DAS statewide price agreements, inmate labor, surplus, or any Oregon Forward Program Contractor.
InVeris/Meggitt Training Solutions is the original equipment manufacturer for all existing automated SIC at the RTC ARF, is the Sole Source Provider for all parts, pieces, components, and upgrades for their system, and the only authorized reseller of the InVeris/Meggitt Training Solutions SIT system installed on the RTC ARF range. The product is solely distributed and supported by InVeris and is not available from other third parties.
