Insurance Requirements and Indemnification

This is an insurance and indemnification requirements document for the Borough of East Stroudsburg, Pennsylvania, detailing mandatory coverage and protections for contractors and consultants performing work on municipal paving projects. The contractor must maintain comprehensive insurance prior to commencing work and throughout contract completion, including workers' compensation with employer liability limits of $1,000,000 per accident and disease, commercial general liability with a $2,000,000 general aggregate and $1,000,000 per occurrence limit, automobile liability with $1,000,000 combined single limit, commercial umbrella liability with $5,000,000 occurrence and aggregate limits, pollution/environmental impairment liability with $1,000,000 per occurrence and $2,000,000 aggregate, and owner's protective liability of $1,000,000 per occurrence and $2,000,000 aggregate. All insurance carriers must maintain an A.M. Best Rating of A- (Excellent) or higher and be licensed to do business in Pennsylvania. The contractor is responsible for ensuring subcontractors maintain compliant insurance coverage. Certificates of Insurance naming the Borough of East Stroudsburg, the Borough's Engineer, and property owners as additional insureds must be submitted to Ann Wingert at UTRS Civil and Environmental Engineering within five days of receiving these requirements and prior to work commencement. Coverage must include waiver of subrogation and recovery endorsements, and all deductibles and self-insured retentions cannot exceed $5,000.

The contractor assumes full indemnification obligations to the borough and engineer for all liabilities, losses, claims, damages, and expenses arising from or connected with the work, including investigation costs, expert witness fees, and legal fees, regardless of whether caused in part by the indemnified parties. Insurance policies must remain primary over other coverage maintained by additional insureds and survive for three years following final payment. Any insurance cancellation, material change, or non-renewal requires thirty days' advance written notice by certified mail. The contractor warrants that all insurance requirements have been reviewed by its insurance agent or broker, and failure to provide satisfactory certificates of insurance prevents work commencement and payment authorization. Should the contractor fail to maintain required insurance, the borough may procure coverage at the contractor's expense and cost. All claims must be settled expeditiously, and failure to settle claims within ten days of notification allows the owner to engage a professional adjusting service with costs deducted from monies due the contractor.
