About this file

This is an Insurance Requirements document issued by the State of Colorado for the Auraria Higher Education Center (AHEC). The document specifies comprehensive insurance coverage mandates that vendors and their subcontractors must obtain and maintain throughout the contract term. Required coverage includes workers' compensation insurance as mandated by state statute with employers' liability coverage, commercial general liability insurance with minimum limits of $1,000,000 per occurrence and $1,000,000 general aggregate, automobile liability insurance with $1,000,000 combined single limit coverage for all vehicle types, and cyber/network security and privacy liability insurance with limits ranging from $1,000,000 to $5,000,000 per claim depending on the number of records held by the contractor.

All insurance policies must be issued by AHEC-approved insurance companies, with the State of Colorado and AHEC named as additional insureds on commercial general liability policies. Coverage must be primary and noncontributory over any existing insurance programs, include 30-day cancellation notice provisions with seven-day notice forwarding requirements to AHEC, and contain subrogation waivers protecting the State, AHEC, and their respective officers, agents, and employees. Cyber liability insurance limits are tiered based on record volume and must increase proportionally as the number of records held by the contractor grows throughout the contract duration. These requirements apply uniformly to vendors and all subcontractors engaged in work under the contract.

E. Primacy of Coverage

Coverage required of Vendor and each Subcontractor shall be primary and noncontributory over any insurance or self-insurance program carried by Vendor or the Auraria Higher Education Center and the State of Colorado.

F. Cancellation

The above insurance policies shall include provisions preventing cancellation or non-renewal, except for cancellation based on non-payment of premiums, without at least 30 days prior notice to Vendor and Vendor shall forward such notice to AHEC within seven days of Vendor’s receipt of such notice.

G. Subrogation Waiver

H. Cyber/Network Security and Privacy Liability

Liability insurance covering civil, regulatory, and statutory damages, contractual damages, data breach management exposure, and any loss of income or extra expense as a result of actual or alleged breach, violation or infringement of right to privacy, consumer data protection law, confidentiality or other legal protection for personal information, as well as State Confidential Information with minimum limits as follows:

i. $5,000,000 each claim; and

ii. $10,000,000 general aggregate. Cyber liability insurance can be limited based on the total number of records being held by the Contractor.

These limits grow throughout the life of the Contract. If the number of records grows over time, the minimum insurance limits must also grow.
