About this file
This is a Site Investigation Memo and correspondence file from the Alabama Department of Environmental Management (ADEM) regarding an unauthorized solid waste dump and scrap tire site remediation project located at 0 Stewart Street, Pike County, Alabama. The site contains approximately 800 cubic yards of construction and demolition waste, household waste, appliances, rubbish, and approximately 500 scrap tires that were illegally dumped on the property. An initial inspection was conducted on March 5, 2026, by Inspector Luke Davis, with the investigation completed on March 11, 2026. The site had recently experienced a fire that burned a significant portion of waste on the western side of the property before local fire department intervention. ADEM issued an Information Request to the property owners, Clifford L and Wilma H Eubanks, on March 11, 2026, requesting detailed responses within thirty days regarding their knowledge of the dump, property acquisition history, due diligence performed, and measures taken to prevent dumping. The property owners were subsequently determined to be innocent landowners and qualified for assistance through the Alabama Solid Waste Fund and/or Alabama Scrap Tire Fund. A Site Access Agreement was provided to authorize remediation activities including site assessment, security, vegetation removal, excavation, scrap tire processing, and site closure.
Remediation activities will be funded entirely by the Alabama Solid Waste Fund and Alabama Scrap Tire Fund, with no cost to the property owners. The project may be competitively bid, with potential for a bid preview meeting held at the site. ADEM, in conjunction with the Alabama Scrap Tire Commission, will coordinate either contractor or local government body selection to perform the remediation work. The property owners were required to sign and return the Site Access Agreement to qualify for the cleanup funding. Critical correspondence was initially sent via certified mail but returned unclaimed and was subsequently resent via FedEx on June 10, 2026. All project inquiries and coordination should be directed to Luke Davis of the ADEM Removals and Response Unit at (334) 271-7840 or luke.davis@adem.alabama.gov.
