About this file
This is an Indian Economic Enterprise (IEE) Representation Form required by the Indian Health Service (IHS) Buy Indian Act compliance documentation. The form serves as a self-certification mechanism for offerors responding to IHS solicitations, sources sought notices, or requests for information to verify they meet the definition of an "Indian Economic Enterprise" under 25 U.S.C. 47 and HHSAR 326.601. Offerors must certify their eligibility status by indicating whether they do or do not meet the IEE definition with Indian ownership, and must provide the name of the federally recognized tribal entity, the 51% owner information, firm business name, DUNS number, and an authorized signature. The certification requirement applies across three critical timeframes: at the time of offer submission, at contract award, and throughout the entire contract performance period.
The form emphasizes that enterprises must maintain continuous eligibility throughout the contract lifecycle and must notify the Contracting Officer immediately if eligibility is lost at any point. Contracting Officers may require supporting documentation of eligibility before making set-aside or sole source contract awards under the Buy Indian Act, and awards are subject to protest if the successful offeror's eligibility is questioned. The form includes explicit warnings that false or misleading information constitutes a violation of 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Successful offerors must also maintain current registration in the System of Award Management (SAM).
