The Contract w ill be Firm-Fixed Price Type for one (1) Base Year of 12 months plus four (4) Option Years of tw elve months each, if exercised by the Government.

NOTICE TO BIDDER

SOLICITATION No : W912C3-23-B-0001, Contractor shall furnishing labor, materials, tools, equipment, supervision, transportation, insurance and all necessary to perform work in connection with the Exterior/ Interior Painting Buildings, and DODEA Buildings at Fort Buchanan, PR 00934.

This solicitation is issued to 8(a) SBA Certified Program Participants firms on a Competitive Basis

Note: 8(a) Firms that are not local shall ensure they are familiar with Puerto Rico laws, tax information and any other required for consideration within your bid package. All interested firms (local and non-local) need to ensure proper consideration of all required for successful completion of all work avoiding delays due to not being able to obtain personnel, equipment or materials.

Please carefully read and complete the entire solicitation. The following are highlighted for your attention:

1. Bidders shall incorporate total price for each period in the Schedule of Supplies/Services (CLINS), Section 0010 and each individual price (for each period) on the incorporated BID/CLIN Schedule.

2. Bidders shall complete all representations and certifications in SAM (www.sam.gov) and submit their bid and annotate their DUNS, CAGE Code and Tax ID Number with their bid.

3. Bidders shall complete the SF1442 first page of solicitation, including appropriate signature.

4. Bidders shall include a 20% Bid Bond Guarantee or other required document with their bid

5. Bidders shall acknowledge and include a copy of any amendments issued to the solicitation with the bid, if applicable.

9. The applicable size standard is $19 Million Dollars.

10. The magnitude of this project is between $5 MILLION and $10 MILLION.

THE TOTAL COST DOES NOT MACTH THE MATHEMATICAL FORMULA, THE UNIT PRICE

PREVAILS.

IN THE SOLICITATION ISSUED WHICH INCLUDES PLANS, DRAWINGS, AND SPECIFICATIONS AS

17. In accordance with Federal Acquisition Regulation 14.304, Bidders are responsible for submitting bids, and any modifications or withdrawals, so as to reach the Government office designated in the invitation for bid (IFB) by the time specified in the IFB. Any bid, modification, or withdrawal of a bid received at the Government office designated in the IFB after the exact time specified for receipt of bids is “late.”

1.1. HAND CARRIED BIDS: A bid box is provided for hand carried bids and is located at the Visitor Control Center (VCC) Fort Buchanan, The Borinqueneers’ Gate, PR28 (Goya). Once you arrive at the Borinqueneers Gate, Fort Buchanan (before the gate guard) stay on the far right lane that will lead you to the entrance of the

VCC.

Hand carried bids must be deposited in the bid box prior to the time established for opening of bids. The bid box will be inside the Visitor Control Center. Only the MICC Contracting Office will have access to the bid box key.

(Note: If bid package too big, it may not fit into bid box slot)

Bidders are cautioned that they should allow time to accomplish the submission of the bid. There may be lines or other restrictions at the gate due to current situation.

2. BID OPENING

THE DATE AND TIME FOR OPENING OF THE BIDS IS: 7 Feb 2023; 10:15 AM LOCAL PUERTO

Vendors wanting to participate in the bid opening will need to ensure they arrive, at least, an hour early in order to be sponsored onto Fort Buchanan. Valid ID, Drivers license for personnel is required. Max Two (2) persons per company.

DUE TO RESTRICTED ACCESS TO FORT BUCHANAN, CONTRACTORS THAT WILL BE

HANDCARRYING THEIR BID ARE REQUIRED TO CONTACT:

THE INFORMATION SHALL BE PROVIDED NOT LATER THAN FIVE (5) FULL WORK DAYS PRIOR TO

THE DATE/TIME OF BID OPENING DATE.

CONTRACTORS ARE CAUTIONED THAT THERE MAY BE DELAYS AT THE GATES AND SHOULD

ALLOW ADEQUATE TIME FOR ENTERING THE INSTALLATION TO ENSURE PACKAGES ARE

RECEIVED PRIOR TO THE TIME AND DATE FOR RECEIPT OF THE BID PACKAGE. ALL

INDIVIDUALS MUST HAVE A PICTURE ID AND NO SUBSTITUTIONS ARE AUTHORIZED. VEHICLES

The Work Schedule Plan shall be provided for each individual Delivery Order with more than 30 Calendar days of performance. Progress Work Reports shall be provided in a weekly basis for each Delivery Order.

23. Municipalities of Puerto Rico like Bayamon and Guaynabo are aggressively audity contractors for payment of municipal taxes. Contractors shall read carefully FAR Clause 52.229-3 Federal, State and Local Taxes.

CONTRACTORS ENSURE BID PRICES INCORPORATES ALL NECESSARY TO PROPERLY PERFORM EACH WORK.

NOTE: ANY CONTRACTOR DELAYS DUE TO NON-PERFORMANCE OF WORK, LACK OF

MATERIAL/EQUIPMENT OR PERSONNEL, WILL NOT BE JUSTIFICATION FOR A TIME EXTENSION.

THE CONTRACTOR SHALL, AT ALL TIMES, MAINTAIN A WORKFORCE FOR UNINTERRUPTED

PERFORMANCE OF ALL TASKS DEFINED WITHIN THIS STATEMENT OF WORK (SOW).

THIS IS A FIRM-FIXED PRICE TYPE CONTRACT: CONTRACTORS WILL BE RESPONSIBLE FOR ANY COST NOT INCORPORATED BUT NECESSARY TO SUCCESSFULLY COMPLETE EACH SUBCLIN. SUBCLINS WILL BE USED IN FUTURE

THE AMOUNT PROPOSED UNDER THIS SUBCLIN WILL BE ADDED TO THE OTHER SUBCLINS

ONLY WHEN WORK IS REQUIRED FOR OTHER THAN NORMAL WORKING HOURS. IT WILL BE

APPLIED TO THE ACTUAL WORK TO BE PERFORMED (METAL, CONCRETE, WOOD

INTERIOR/EXTERIOR) IN THE DELIVERY ORDER.

(a) The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government, considering only price and the price-related factors specified elsewhere in the solicitation.

(b) The Government may reject any or all bids, and waive informalities or minor irregularities in bids received.

(c) The Government may accept any item or combination of items, unless doing so is precluded by a restrictive limitation in the solicitation or the bid.

(d) The Government may reject a bid as nonresponsive if the prices bid are materially unbalanced between line items or subline items. A bid is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low evaluated bid, or if it is so unbalanced as to be tantamount to allowing an advance payment.

The Government contemplates award of a Firm-Fixed Price Type contract resulting from this solicitation.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Buildings and Department of Defense Education Activity (DODEA) at Fort Buchanan, PR 00934

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20 percent of the bid price of the base year or $________, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

52.203-6 RESTRICTIONS ON SUBCONTRACTOR SALES TO THE GOVERNMENT (JUN 2020)

(a) Except as provided in (b) of this clause, the Contractor shall not enter into any agreement with an actual or prospective subcontractor, nor otherwise act in any manner, which has or may have the effect of restricting sales by such subcontractors directly to the Government of any item or process (including computer software) made or furnished by the subcontractor under this contract or under any follow-on production contract.

(b) The prohibition in (a) of this clause does not preclude the Contractor from asserting rights that are otherwise authorized by law or regulation.

(c) The Contractor agrees to incorporate the substance of this clause, including this paragraph (c), in all subcontracts under this contract which exceed the simplified acquisition threshold, as defined in Federal Acquisition Regulation

2.101 on the date of subcontract award.

52.203-10 PRICE OR FEE ADJUSTMENT FOR ILLEGAL OR IMPROPER ACTIVITY (MAY 2014)

(a) The Government, at its election, may reduce the price of a fixed-price type contract and the total cost and fee under a cost-type contract by the amount of profit or fee determined as set forth in paragraph (b) of this clause if the head of the contracting activity or designee determines that there was a violation of 41 U.S.C. 2102 or 2103, as implemented in section 3.104 of the Federal Acquisition Regulation.

(b) The price or fee reduction referred to in paragraph (a) of this clause shall be--

(1) For cost-plus-fixed-fee contracts, the amount of the fee specified in the contract at the time of award;

(2) For cost-plus-incentive-fee contracts, the target fee specified in the contract at the time of award, notwithstanding any minimum fee or "fee floor" specified in the contract;

(3) For cost-plus-award-fee contracts--

(i) The base fee established in the contract at the time of contract award;

(ii) If no base fee is specified in the contract, 30 percent of the amount of each award fee otherwise payable to the Contractor for each award fee evaluation period or at each award fee determination point.

(4) For fixed-price-incentive contracts, the Government may--

(i) Reduce the contract target price and contract target profit both by an amount equal to the initial target profit specified in the contract at the time of contract award; or

(ii) If an immediate adjustment to the contract target price and contract target profit would have a significant adverse impact on the incentive price revision relationship under the contract, or adversely affect the contract financing provisions, the Contracting Officer may defer such adjustment until establishment of the total final price of the contract. The total final price established in accordance with the incentive price revision provisions of the contract shall be reduced by an amount equal to the initial target profit specified in the contract at the time of contract award and such reduced price shall be the total final contract price.

(5) For firm-fixed-price contracts, by 10 percent of the initial contract price or a profit amount determined by the Contracting Officer from records or documents in existence prior to the date of the contract award.

(c) The Government may, at its election, reduce a prime contractor's price or fee in accordance with the procedures of paragraph (b) of this clause for violations of the statute by its subcontractors by an amount not to exceed the amount of profit or fee reflected in the subcontract at the time the subcontract was first definitively priced.

(d) In addition to the remedies in paragraphs (a) and (c) of this clause, the Government may terminate this contract for default. The rights and remedies of the Government specified herein are not exclusive, and are in addition to any other rights and remedies provided by law or under this contract.

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 3 calendar days after issuance of Individual Task Order, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the date stated in the Individual Task Order. The time stated for completion shall include final cleanup of the premises.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $55.54 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $500.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor -

(1) Any order for a single item in excess of $150,000.00;

(2) Any order for a combination of items in excess of $450,000.00; or

(3) A series of orders from the same ordering office within thirty 30 days that together call for quantities exceeding the limitation in paragraph (b) (1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 3 working days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 INDEFINITE QUANTITY. (OCT 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum".

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after Expirate.
