1.6 BASIS OF AWARD
In accordance with FAR 52.214-19, Award will be made to the responsive and responsible bidder that submits the lowest price. The Government will evaluate bids in response to this solicitation without discussion and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government considering only price and the price-related factors specified elsewhere in the solicitation.
To be considered responsive, contractor bids must conform to the solicitation, be complete and accurate, and include all information required by this IFB.
The Government may reject a bid as non-responsive if the prices bid are materially unbalanced between line items or subline items. A bid is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low evaluated bid.
To be considered responsible, the Government will follow the requirements in FAR
9.104. The Low, Responsive Bidder will be required to submit a response to a responsibility questionnaire, in accordance with FAR 9.105, within five (5) business days

1.13 BID EVALUATION
In accordance with FAR 52.214-19, Award will be made to the responsive and responsible bidder that submits the lowest price. The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government considering only price and the price-related factors specified in this IFB. Prior to award, a responsibility questionnaire will be conducted with the lowest, responsive bidder, who will be required to submit evidence of their responsibility. Bids will be evaluated as follows:
1) To determine if the lowest priced bidder is responsive, the Government will evaluate the lowest priced bid to determine if the bid is complete and accurate, and includes all information required by this IFB. An incomplete or inaccurate bid may deem the bid https://www.fiscal.treasury.gov/surety-bonds/list-certified-companies.html https://www.fiscal.treasury.gov/surety-bonds/list-certified-companies.html
SECTION L – FA8903-25-B-0002
non-responsive. The Government may waive informalities or minor irregularities in the bid received, if determined to be advantageous to the Government.
2) The lowest bidder's bid schedule will be evaluated for balancing of line items. The Government may reject a bid as non-responsive if the prices bid are materially unbalanced between line items (CLINs) or sub-line items (Sub-CLINS). A bid is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the lowest evaluated bid or if it is so unbalanced as to be tantamount to allowing an advance payment.
3) In order to obtain information required to determine bidder responsibility, the lowest price bidder will be required to complete a responsibility questionnaire within five (5) calendar days after bid opening. See Paragraph 1.15 for submission requirements. To determine if the lowest bidder is responsible, the Government will follow the guidance in FAR 9.104-1, as follows:
a) In accordance with FAR 9.104-1(a), to ensure the bidder has adequate financial resources, the Government will ensure the penal sum of the bidder's bid bond is in the amount of 20% of the bid price or $3M, whichever is less. The Government will also contact the banking and bonding point of contact submitted with the responsibility questionnaire to verify the bidder's financial capability. Incomplete or invalid information provided may deem the bidder non-responsive. A bid bond submitted by a Bonding Company that is not included in the list of federally approved sureties will result in the bidder being non-responsible. A determination that a bidder has less than satisfactory financial standing may deem the bidder non-responsible.
b) In accordance with FAR 9.104-1(b), to ensure the bidder can comply with the required period of performance, the Government will review the Construction Schedule submitted with the bidder's response to the responsibility questionnaire.
If the low bidder’s Construction Schedule includes all Primary Definable Features of Work (DFOW) necessary to complete construction within the required period of performance, the Air Force will have confidence that the bidder has the resources, capability, and availability to comply with the performance period requirements of this IFB and will therefore determine the bidder to be responsible.
However, failure to include all pertinent DFOW’s within the allotted period of performance may deem the bidder non-responsible.
c) In accordance with FAR 9.104-1(c), to ensure the bidder has a satisfactory performance record, the Government will search Contractor Performance Assessment Reporting System (CPARS) database for construction of airfield paving projects over $25M that were completed by the Prime Offeror within the last five years from the date bids were opened. Any performance information that would lead the contracting officer to believe the bidder may pose a high risk in its ability to satisfactorily perform the contract resulting from this IFB, may deem the bidder non-responsible. A bidder shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history.
SECTION L – FA8903-25-B-0002
d) In accordance with FAR 9.104-1(d) and (g), to ensure the bidder has a satisfactory record of integrity and business ethics and is otherwise qualified and eligible to receive an award, the Government will review the information in the System for Award Management (SAM.gov) to include information on a bidder's suspension or debarment and CPARS. Additionally, we will also analyze Supplier Performance Risk System (SPRS) data for adequate compliance. Any less than satisfactory information found within SAM.gov, CPARS, or SPRS may determine the bidder to be non-responsible.
e) In accordance with FAR 9.104-1(e) and (f), to ensure the bidder has the necessary organization, experience, accounting and operational controls, technical skills, construction, and technical equipment necessary to complete this work; the Government will review the project information provided in response to the responsibility questionnaire to support the bidder's key personnel experience in performing Air Force, Department of Defense (DoD) or Federal Aviation Administration (FAA) airfield full-depth PCC reconstruction projects, to ensure the projects meet the minimum experience requirements. See Paragraphs 1.15 1)
(b) and 1.15 1) (c). Any information provided that does not meet the minimum experience identified in these paragraphs, may deem the bidder non- responsible.
4) If the lowest bidder meets all requirements to be determined responsive and responsible, award will be made to that bidder, upon receipt of funds. If the lowest bidder is determined to either be non-responsive or non-responsible, the Government will evaluate the bid of the next-lowest bidder, and upon receipt of funds, will award to that bidder if it is determined to be responsive and responsible. This evaluation process will continue until the Government selects the lowest responsive and responsible bidder.
1.14 JOINT VENTURES
No contract may be awarded to a joint venture that is not registered in the System for Award Management (SAM). Joint ventures may register by contacting the SAM at http://www.sam.gov. In the cover letter of your bid, provide the complete names, addresses, and phone and fax numbers of all firms in the joint venture.
Signature requirements: SF 1442, SOLICITATION, OFFER, AND AWARD, Block 20 requires that the name and title of the person authorized to sign the bid for the joint venture be provided.
In addition to the requirements stated above, and to assure a single point of contact for resolution of contractual matters and payments, submit a certificate signed by each participant in the joint venture that includes the following statement:
"The parties hereto expressly understand and agree as follows:
a) (Name, title, and company) is the principal representative of the joint venture. As such, all communications regarding the administration of the contract and the performance of the work there under may be directed to him or her. In the absence of
SECTION L – FA8903-25-B-0002
(same name, title, and company), (enter name, title, and company of alternate) is the alternate principal representative of the joint venture.
b) Direction, approvals, required notices, and all other communications from the Government to the joint venture, including transmittal of payments by the Government, shall be directed to (enter name, title, and company of principal), principal representative of the joint venture."
The bid bond form, Block "Principal" requires that the name and title of the person authorized to sign for the joint venture be included.
After award of the contract resulting from this IFB, performance and payment bonds, and insurance certificate(s) provided shall be in the name of the joint venture.
1.15 RESPONSIBILITY QUESTIONNAIRE TO DETERMINE BIDDER
RESPONSIBILITY INFORMATION (DO NOT INCLUDE WITH THE BID)
After the bid opening a “responsibility questionnaire” will be provided to the lowest priced, responsive bidder to verify they comply with FAR 9.104-1 (a) through (g). SECTION L – FA8903-25-B-0002
b) Lowest Bidder's experience performing full-depth PCC reconstruction projects on DoD or FAA-regulated airfields (this is typically the experience of a specialized Sub-Contractor; however, if the Lowest Priced Bidder physically performed the construction with its own in-house staff, then experience from the Lowest Priced Bidder is acceptable – note that experience from a General Contractor that sub-contracted the full-depth PCC reconstruction, is not considered sufficient.)
Full-Depth PCC reconstruction on DoD or FAA-regulated airfields requires special knowledge of the FAA and Unified Facility Criteria (UFC) standards, Unified Facilities Guide Specifications (UFGS), Air Force and FAA/DoD policy, state, county, and local regulations, and laws. Accordingly, the bidder must demonstrate that the contractor performing the work has experience with these requirements.
i) Submittal Requirements:

(3) For at least two (2) of the three (3) projects, demonstrate the construction scope included at least 25,000 cubic yards of airfield/airport PCC pavement constructed to DoD UFGS specification 32 13 14.13 or to FAA AC 150/5370-10H, or any of those specifications' previous versions.
iii) Sufficient DoD/FAA Airfield Full-depth PCC Reconstruction Experience:
SECTION L – FA8903-25-B-0002
In accordance with FAR 9.104-1(e) and (f), to determine if the bidder has the necessary experience and technical skills to perform the contract resulting from this IFB, the Government will review the Lowest Bidder’s experience performing full-depth PCC reconstruction projects on DoD or FAA-regulated airfields. The Government will determine the bidder to be responsible in this area, if the bidder demonstrates the experience meeting or exceeding the following minimum requirements:
a. Projects were completed within the last ten (10) years from the date this solicitation's bids will be opened.

e) Bidder's Past Performance:
CPARS (www.cpars.gov) database will be searched for past performance information for construction of airfield paving projects over $25M that were completed by the Prime Offeror within the last five years from the date bids were opened; however, the Government reserves the right to obtain past performance information from any other sources available to include, but not limited to, interviews with Program Managers, Contracting Officers, and the Defense Contract Management Agency. A prospective contractor shall not be determined responsible or nonresponsible solely on the basis of a lack of relevant performance history.
2) For items 1)b) and 1)c) above, the bidder MUST use the key personnel and subcontractors included in response to the responsibility questionnaire during the performance of work of this contract. Any changes must be approved by the contracting officer prior to replacing key personnel or subcontractors beginning any work, and the changed key personnel or subcontractors must meet the minimum requirements identified in this IFB. The contractor's right to proceed with work may be suspended by the contracting officer until a new key personnel or subcontractor is approved, at no additional cost to the Government and with no additional time added to the period of performance. The contractor shall allow five (5) business days for the contracting officer to approve or reject changes to subcontractors or key personnel.
3) No award will be made unless the bidder can demonstrate the above experience and qualifications. If the lowest-priced responsive bidder is determined NON-responsible and does not successfully obtain a Certificate of Competency (COC) from the Small Business Administration (SBA), no further consideration will be given to that bidder and a responsibility questionnaire will be issued to the next-lowest priced bidder to determine their responsibility.
