8) CONTACT WITH NTC
During the time period from the issue date of this IFB until NTC has notified all Vendors of its decision, all contact with any other NTC or Wisconsin Technical College System employee concerning this IFB is prohibited, except as authorized by the NTC purchasing department. Failure to adhere to this provision may be cause for disqualification of a supplier’s submission.
9) ALTERNATE BIDS
Specifications contained in this IFB are intended to define the level of quality and performance and not to restrict competition. Suppliers offering alternates shall submit an itemized comparison to the IFB specifications, documenting differences. Unless indicated otherwise, suppliers may offer more than one alternative. Where certain brands or part numbers are specified, it is for illustration or to establish a standard for features and construction. Unless indicated otherwise, equivalents are acceptable and allowed, and suppliers are encouraged to offer varying brands of equivalent items and supplies for NTC’s consideration.
10) EQUIVALENT DETERMINATION
Because some designs of equipment or services vary among different Vendors, NTC may accept bids on products or services with minor deviations to the written specifications. Generally, a minor deviation is defined as a deviation which: (A) Does not materially affect the ability of the product or services to achieve or accomplish a necessary function or task in the manner required by the specifications; (B) does not compromise the safety of the use thereof; and, (C) does not produce higher installation or future costs to NTC in any of a multiplicity of ways. NTC specifically reserves the right to make the final judgment concerning what is or is not a minor deviation and to award to the Vendor(s) whose bid(s) best suits NTC’s needs.
11) DEVIATIONS AND EXCEPTIONS
Deviations and exceptions from terms, conditions, or specifications shall be described fully, on the Vendor's letterhead, signed, and attached to the bid form.

12) TRADE NAME
A trade name followed by the phrase "or equal" is used to indicate style and quality desired. "Or equal" shall be interpreted to indicate the type, function, design, efficiency, and quality desired. "Or equal" shall not be construed in such a manner as to exclude the Vendor’s products or services of comparable quality, design, and efficiency. NTC shall make the final decision as to equality or relative merit.
13) BONDS
When requested within the specification or scope of services, a bid bond, certified check, cashier’s check, or money order for 5% of the bid must accompany all bids to be considered. When requested, a performance bond in the amount of 100% of the awarded bid must be furnished by the successful Vendor within ten (10) days of receipt of the purchase order.
14) WITHDRAWALS OF BIDS
Prior to the designated IFB due date and time, any Vendor may withdraw his or her bid submission. After the designated IFB due date and time, no bid shall be withdrawn for a period of sixty (60) days.
15) ACCEPTANCE/REJECTION
Compliance with all bid specifications and conditions is required. NTC reserves the right to accept or reject any or all bids or parts of bids for any reason, to waive any irregularities or to make the award in such manner as may be deemed by NTC to be right and proper and in the best interest of NTC. NTC’s award determination shall be final.
16) LEVEL OF COMPETING BIDS RECEIVED
NTC reserves the right to reject all bids received and to reissue the IFB if an adequate level of competition was not obtained, or if specifications/terms did not allow for a sufficient level of competing bids, or if desired specifications, features, or standards were not acceptable.
17) LIABILITY
NTC is not liable for any costs incurred in responding to any bids. All bids become the property of NTC and are considered public records (not confidential).

The Vendor must pay all freight charges and the Vendor owns the products while in transit.
20) TAX EXEMPTION STATUS

In the case of a multiple vendor award, NTC may solicit quotes for projects, utilizing the contractor with the lowest total cost, able to meet schedule requirements. NTC reserves the right not to make any awards pursuant to this IFB. A Vendor may not appeal the subjective judgment or scoring by NTC evaluators, unless the Vendor can show violations of a specific statute or administrative code. NTC will notify Vendor(s) of award(s), if any, as soon as possible after the bid due date.
22) BEST AND FINAL OFFER (BAFO)
The BAFO step represents an optional step in the IFB selection process and is not part of the subsequent contract negotiation. NTC, at its sole discretion, may request a BAFO submission from those Vendor(s) most likely to be awarded a contract in order to further clarify items such as IFB deliverables, contract language, or costs. Evaluation of the BAFOs will be based on the evaluation criteria set forth in the IFB. After evaluation of the final BAFO submissions, the Evaluation Committee will recommend an award to the Vendor(s) who conform to the IFB and is most advantageous to NTC, provided mandatory IFB requirements are satisfied.
Because the BAFO step is optional, Vendors should submit their best bid in their original submission.
