About this file

The document is a Notice of Intent to Award issued by the Kissimmee Utility Authority (KUA) Procurement Division for Invitation for Bid (IFB) 25-063-JG, a project to mill and repave the Transformer & Wire Storage Area. KUA intends to award the contract to Asphalt365 Inc., subject to final approval by the KUA Board of Directors. The notice is dated September 2, 2025, and pertains to a solicitation for infrastructure improvement work at a utility facility.

The notice indicates that while Asphalt365 Inc. has been selected as the apparent successful bidder, no legal or equitable rights are established until a formal contract is executed. KUA retains the discretion to revoke the award if the selected bidder fails to negotiate and execute the contract, and may alternatively award to the next lowest responsive and responsible bidder, reject all bids, cancel the solicitation, or re-solicit at a later time. The document also includes a provision for potential bidders to file a written notice of protest within 72 hours of the posted decision, with specific instructions to contact KUA Procurement personnel for comprehensive protest procedures.

NOTICE OF INTENT TO AWARD

September 2, 2025

To: All Interested parties

RE: IFB 25-063-JG, Mill & Repave Transformer & Wire Storage Area

All, Kissimmee Utility Authority (“KUA”) hereby provides notification of its intent to award the above referenced solicitation to the following firm(s):

Asphalt365 Inc.

This Notice of Intent to Award is subject to final approval by the KUA Board of Directors, as applicable. Therefore, this Notice of Intent does not constitute the formation of a contract between KUA and the apparent successful bidder. The successful bidder shall not acquire any legal or equitable rights relative to this solicitation until a contract or purchase order, containing terms and conditions acceptable to KUA, is duly approved and executed by KUA.

In the event the apparent successful bidder fails to accept, negotiate, and execute a contract with KUA, KUA may, at its sole discretion, revoke the award and proceed to award to the next lowest, responsive and responsible bidder, reject all bids received, cancel the solicitation, and/or re-solicit at a later time. KUA further reserves the right to cancel this Notice of Intent to Award at any time prior to execution of the contract or purchase order, as applicable.

Thank you for your interest in doing business with KUA. We look forward to receiving your submittals in the future.

Sincerely, Jennifer Grieves Buyer cc: project file
