1.
IFB Section 24 – Quantities

Attachment 1 – Pricing Worksheet Addendum 1

I understand that the bags will be called for on an as needed basis. However, for the purposes of planning and shipment cost calculations it would be very helpful to get a rough estimate of the number of shipments expected. Would you please be able to share any information from prior years that help estimate the number of deliveries and the average number of bags per delivery?
Orders are placed on an as-needed basis for delivery to the location on the purchase order document within the state of California. Based on past trends, there is some variability in order frequency and quantity. The estimated order sizes by weight are detailed in the Pricing Worksheet. However, the State will not guarantee that these quantities will be purchased. Consequently, there is no guaranteed dollar value for this contract. To view historical purchases, please visit the State Contract & Procurement Registration System (SCPRS) on Cal eProcure: FI$Cal SCPRS Search. Enter the LPA Contract ID (1-20-81-03) in the Advanced Search option.

Event ID #: 0000016327 dated April 29, 2020
Please can you share prior bid tabulation if available?
For a copy of public records, please submit your request via the GovQA system.
3.
IFB Section 52 – Delivery Schedules
The solicitation mentions that delivery is expected 30 days after receipt of an order (ARO). Would you be ok with the very first delivery being in about 75-90 days? Once we have the initial stock ready, we can then meet the 30 days ARO.
Awarded contractors shall comply with delivery requirements upon award. Delivery of ordered product shall be completed in full within 30 calendar days after receipt of an order, unless otherwise agreed to by the ordering agency.
4.
IFB Section 29 – Authorized Reseller
Our manufacturing is overseas. Is that acceptable?
Yes. However, all bids, and any resulting contract awards shall comply with the solicitation requirements, and all applicable statutes, rules, regulations, and orders of the United States and the State of California. If the Bidder is not the Original Equipment Manufacturer (OEM) of the product being proposed, the Bidder must provide, on OEM company letterhead and signed by an authorized OEM representative, documentation identifying the Bidder as an authorized OEM reseller.
5.
Attachment 1 – Pricing Worksheet Addendum 1
Please could you confirm that there are 500 bags in a bundle?
The Estimated Quantity has been revised to reflect the number of individual bags instead of Per Bundle of 500 bags. Please refer to Pricing Worksheet Addendum 1 Column B.
6.
Attachment 1 – Pricing Worksheet Addendum 1
Are the quantities you listed annual usage or monthly usage?
These numbers in Column B on the Pricing Worksheet represent three years of estimated purchase quantities. These quantities are based off historical purchasing data.
7.
IFB Section 29 – Authorized Reseller
Please clarify Section 29. Authorized Reseller

Is this meant for this specific bid, or was the language left there in error?

If it is meant for this bid, how does that work when the item is not being purchased directly from the (OEM) manufacturer? If the grocery bags are being purchased from a master distributor, would we just need a chain of letters? (example: Official letter from OEM to master distributor, then a letter from the master distributor to the bidder?)

A letter from the distributor is acceptable.

IFB Addendum 2 updates the language in Section 29 regarding the authorized reseller.

8.
IFB Section 8 – Small Business/Disabled Veteran Business Enterprise (SB/DVBE) Off-Ramp
After reviewing the bid packet, we have a major concern regarding Section 8. Small Business/Disabled Veteran Business Enterprise (SB/DVBE) Off-Ramp. We believe it should be removed.

The bid for grocery bags has a requirement for special made items that are specific to the state corrections needs. The bid specifications are very detailed and specific as to what the contracts needs are. These special made items require a purchase commitment. There would need to be a commitment that the agencies are actually going to buy from the company that is awarded this contract. That commitment has always been with a Mandatory contract. There cannot be an SB/DVBE off ramp option, because this would put the bidder at risk. No company can afford to have specialty made items printed specifically for a contract and then have the potential of no one buying them. Doing business that way would basically be hanging a Small/DVBE business out to dry.

IFB Addendum 2 updates the language in Section 8 regarding the off-ramp provision.
