About this file

This document is a Statement of Work for a Request for Information (RFI) for Court Document Retrieval Services. The RFI is being issued by Immigration and Customs Enforcement (ICE), Enforcement and Removal Operations (ERO) to conduct market research into obtaining court document retrieval services that will allow ERO to efficiently retrieve mission-critical court records.

The contractor must provide a secure, web-based platform that is FedRAMP approved and FISMA compliant, allowing up to 150 concurrent ICE users to request and receive available archived and non-archived court-certified documentation from U.S. state, county, and municipal courts, as well as U.S. territories. The contractor must deliver non-archived hard-copy court-certified documents within 3 business days, and archived hard-copy documents within 10 business days. Electronic copies of documents may also be provided. The contractor must provide status updates on all requests and submit monthly reports on request timelines. Training and user management support for the platform must also be provided. The period of performance is one 12-month base period with four 12-month option periods.

ICE Enforcement and Removal Operations

Court-Certified Documentation Retrieval and Delivery Services Statement of Work

GENERAL

1.0 BACKGROUND

The arrest, detention, and removal of criminal noncitizens from the United States is one of U.S.

Immigration and Customs Enforcement’s (ICE) current priorities. To initiate Removal Proceedings under the Immigration and Nationality Act, court-certified documentation is required to sustain removability charges based on criminality.

Currently, ICE retrieves U.S. federal court-certified documentation through Public Access to Court Electronic Records (PACER) at pacer.uscourts.gov, while state, county and municipal court-certified documentation is either retrieved in person or requested via mail by ICE personnel.

This current method of retrieving non-federal court-certified documentation requires significant staff-hours on the part of ICE and results in increased administrative costs and delays in removal proceedings. Although PACER will continue to be utilized to retrieve U.S. federal court-certified documentation, ICE has a need and new requirement for contractor support to retrieve and deliver non-federal court-certified documentation in an expeditious and efficient manner.

1.1 SCOPE

The scope of this requirement includes access to a secure web-based platform that grants ICE users the ability to request and receive available archived and non-archived court-certified documentation from U.S. state, county, and municipal courts as well as U.S. territories and the associated court jurisdictions therein. This requirement will support government personnel at all ICE/ERO field/sub-offices throughout the U.S. requested court-certified documentation may include, but is not limited to, the following:

• Indictments

• Complaints

• Judgments – Conviction and/or Sentencing

• Police reports

• Motions

• Briefs

• Plea Minutes

• Opinions

• Probation Documents (such as pre-sentence investigations)

• Traffic Citations

• Docket reports

Note: The scope of this requirement does not include contractor data migration support for existing court-certified documentation currently in the possession of ICE nor does the scope of this effort require data storage support for court-certified documentation received during the period of performance of this effort.

2.0 SPECIFIC REQUIREMENTS/TASKS

2.1 Web-based Court Document Retrieval Service Platform Capability

The contractor shall have the capability to provide a secure web-based platform, FedRAMP approved and meet FISMA Standards, that grants ICE users the ability to request and physically and/or electronically receive available archived and non-archived court-certified documentation from U.S. state, county, and municipal courts as well as U.S. territories and the associated court jurisdictions therein. The contractor shall be responsible for all maintenance and operation of this web-based platform.

2.2. ICE User Access

2.2.1 Access Capability

The contractor shall have the capability to provide access for up to 150 concurrent ICE users.

2.2.2 Contracting Officer’s Representative Approval

Contracting Officer’s Representative (COR) approval is required prior to the contractor adding or deleting ICE users. Email correspondence is an acceptable medium for this approval. The contractor shall add new users or delete existing users within one (1) business day following the day of COR approval.

Once ICE personnel are granted access to the platform, no other Government approvals are required when ICE users request court-certified documentation.

2.2.3 Secure Accessibility

The platform shall be accessible securely by username and password and/or Personal Identity Verification (PIV) card.

2.3 Court Document Request Criteria

The platform shall allow ICE users to electronically request specific court documents using criteria such as jurisdiction, subject name and date of birth, document number, case number, docket number, state ID number, FBI Number, and other unique or miscellaneous identifiers commonly used by localities to identify case records.

2.4 Non-Archived/Archived Court Document Delivery

2.4.1 Non-Archived Hard-Copy Court-Certified Documentation

The contractor shall provide, via U.S. mail or contract carrier, physical, non-archived hard-copy court-certified copies directly and only to the requesting ICE user within three (3) business days following the day of the request. In cases where the ICE user works from a location with remote mail screening protocols in place, the contractor will comply with the protocols, which may include using a mailing address different from the user’s physical location.

2.4.2 Archived Hard-Copy Court-Certified Documentation

The contractor shall provide, via mail, physical, archived hard-copy court-certified copies directly and only to the requesting ICE user within 10 business days following the day of the request.

2.4.3 Electronic Copies of Court Documentation

Electronic copies of court documentation may also be requested by ICE users to support removal proceedings while hard-copy court-certified documentation is enroute to the user. In these cases, electronic copies of non-archived and archived court documentation shall be emailed directly to the ICE user or be made accessible (via download) from the web-based platform prior to mailing the hard-copy record(s).

2.5 Status of Requested Documentation

The contractor shall provide status updates directly to ICE users for all requests, including, but not limited to, receipt of request, processing status, delays, delivery, and completion. Status of delays shall also include the reason for the delay and an estimated time of delivery. Status updates may be provided to users via email or be made accessible through the web-based platform.

2.6 Training and User Management Support

The contractor shall provide training and user management support for all users to ensure proper guidance and navigation of the platform.

2.7 Monthly Timeline Summary Report

The contractor shall develop and submit a monthly report that provides timeline data for each ICE user request during the preceding month.

At minimum, the report shall include the timeline for each ICE user requested document from the date of the request through delivery. The contractor shall determine the format of the report and include other timeline data deemed beneficial for Government evaluation. The report shall be submitted to the Government 10 business days following the end of each contract month.
